CD-79-82 - Our File: 35.60.13. SUBJECT: EVALUATION OF LOCAL ARCHITECTURAL CONSERVATION ADVISORY COMMITTEE STRUCTURE AND RIGHT TO HOLD OFFICE RECOMMENDATIONS: 1. That this report be received for information. BACKGROUND AND COMMENT: Councillor Prout, at the Council meeting of Monday, November 22, 1982, requested that a review be undertaken to determine the authority under which appointments are made to the executive of the L.A.C.A.C. Committee. In particular, the request was to establish whether persons who resided outside the municipality could be appointed or elected to the Committee's Executive. The Statutory authority for the establishing of a Local Archictectural Conservation Advisory Committee is found in the Ontario Heritage Act, 1974. Pursuant to that authority, Council did, on February 7th 1977, enact a By-law (77-6) to establish a committee for the Town of Newcastle. Having regard for the fact that its function is that of an advisory body relating to heritage matters, there is nothing in the legislation which specifies or establishes the qualifications an individual must have to serve as a member of the committee, or hold office. The guidelines for the establishing of such committees suggests, that "each community must decide who will best serve its heritage needs, taking into account their qualifications, knowledge of the community and their enthusiasm.
