REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF
SEPTEMBER 13, 1982.

SUBJECT: APPLICATION TO ESTABLISH PROPERTY BOUNDARIES
BLOCK 'A' SMART PLAN (LOTS 1 to 10)
FIRST STREET, EAST BEACH
RECOMMENDATIONS:
1. That this report be received; and
2. That Mr, David Sims, Town Solicitor, be requested to undertake all of
the actions necessary to resolve the boundary problems in 1983; and
3. That Mr. Merrill D. Brown, O.L.S. be requested to prepare the necessary
reference plans in accordance with the requirements of the Director of
Titles in 1983; and
4. That an allocation of $10,000 be provided in the 1983 budget to cover
the estimated cost of the project; and
5. That all of the property owners affected be invoiced for their share
of the costs as soon as such costs are known; and
6. That all owners be required to reimburse the Town for their portion of
the costs as soon as they are billed.
BACKGROUND AND COMMENT:
On June 14th 1982, the Committee endorsed the recommendations contained in
Report CD-30-82. Recommendations 5 and 6 stated:
5. That prior to the implementation of the other recommendations
2, 3 and 4, all of the property owners affected be advised of the
problem, the manner of its resolution and the estimated cost to be
assessed to each of them;

6. That in the event serious objection is received from the affected
property owners, Council reconsider the program.
This department prepared and circulated a form letter to all of the property
owners affected on June 22nd 1982 (copy attached) . Subsequently, at the
request of the property owners, a meeting was held in Court Room #2 on
July 13th 1982. Following a lengthy discussion of the problem, its
resolution and the cost, the residents agreed to meet privately and provide
this office with their comments by July 30th 1982.
On July 22nd 1982, a form of petition was received which requested that
"the Town proceed as noted in the letter. " (copy attached) It appears
from the petition that it was an almost unanimous decision to have the work
done. Receipt of the petition was acknowledged by letter dated July 22nd 1982 ,
addressed to Mrs. Gladys E. Gingell . (copy attached)
Recommendations 5 and 6 in Report CD-30-82 have been met and, it would be
appropriate to have the necessary works undertaken by the Town Solicitor
and the surveyor early in the new year (1983) , and an allocation to cover
the estimated cost of $10,000 be included in the 1983 municipal budget.
