CD-53-82 OUR FILE: 68.31. 108. SUBJECT: CEMETERY PROPERTY, LOT 32, CONCESSION 2, FORMER TOWNSHIP OF CLARKE, BEING PART 9 ON M.T.C. PLAN P-3064-47 (FORMER GRAHAM PROPERTY) RECOMMENDATIONS: 1. That this report be received; and 2. That Mr. Warren Poole, Property Agent Land Management, Property Section, of the Ministry of Transportation & Communications, Downsview, be advised that the Town accepts the Ministry's offer to fence and provide non-vehicular access to the cemetery on Lot 32 , Concession 2, former Township of Clarke, and is prepared to take over the property described as Part 9 of Plan P-3064-47; and 77_A,5_ 3. That By-law be amended appropriately; and 4. That the amending By-law be forwarded to the Cemeteries Branch of the Ministry of Consumer and Commercial Relations; and 5. That the Clarke Cemetery Board be so advised. BACKGROUND AND COMMENT: The attached letter from the Property Section of the Ministry of Transportation and Communications, relative to a cemetery found on property which they have acquired for road widening of the 115/35 Highway, was received by the Public Works Department and forwarded to the Clerk's Department on August 4, 1982. Continued . . . . . /2 y}�`p ky �ca> CD-53-82 - 2 - September 13, 1982 By reason of Section 62 (Abandoned Cemeteries) of the Cemetery Act, the maintenance. of the cemetery is automatically the responsibility of the Municipality which is considered to be the owner. It would be appropriate for the Town to accept the Ministry's offer to fence the property and provide non-vehicular access and accept the property from them. It will be necessary to amend Schedule 'A' to By-law 77-25 to include this cemetery in the list of abandoned cemeteries in the former Township of Clarke, forward the By-law to the Cemeteries Branch of the Ministry of Consumer and Commercial Relations, and advise the Clarke Cemetery Board. The Cemetery is Part 9 . The Ministry is prepared to fence and provide non- vehicular access to the cemetery, if the Town is prepared to purchase the property for $1.00. Please also find attached a copy of a letter from Mr. J . Ferguson of the Works Department to our Mr. Frank Sworik, dated July 4, 1980.
