REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF
JULY 26TH 1982

SUBJECT: RENAMING OF THE NEWCASTLE COMMUNITY HALL
RECOMMENDATIONS:
1. That this report be received; and
2. That the Newcastle Historical Society be provided with a
copy of the report for review; and .
3. That upon receipt of a name or list of names the Town' s
Solicitor be requested to review the deed document and
the name(s) and advise Council on the legality of the action
proposed.
BACKGROUND AND COMMENT:
At the Council meeting of July 5th 1982, consideration was given to a letter
dated June 21st 1982, from the Secretary-Treasurer of the Newcastle Community
Hall Board with respect to the renaming of the Community Hall .
Two resolutions were subsequently passed by Council :
(a) to receive the letter for information ; and
(b) to refer the correspondence to staff to research and report
to Committee on whether the name of the Newcastle Community
Hall can be legally changed.
The subject land and building came into the Village of Newcastle, and now the
Town' s possession, through a gift of deed from Chester Daniel Massey, dated
July 30th 1923. The deed document clearly describes the property, its location
and, more particularly the uses to be permitted within the confines of the
property.

Of singular significance is the first provision in the deed which provides as
follows:
"The name of the building now erected on the
said lands and any building that may be hereafter
erected in substitution therefor, shall be and
remain "COMMUNITY HALL. "
Based upon this provision, it would be contrary to the conditions under which
the property were deeded to the former Village of Newcastle to alter the name
in any way which would result in the removal of the words "Community Hall "
from the name given to the building. At present, the facility is known as
the "Newcastle Village Community Hall ;" this title does not contravene the
conditions of the deed as the name contains the words prescribed in the deed.
If the Newcastle Historical Society is intent upon renaming the structure, it
would be appropriate for them to establish a name, or list of names and then
have the matter of the proposed name change reviewed by the Town's Solicitor.
Only in that way could the Society be assured that any change of name, met
the conditions imposed by the deed.

Re: Renaming the Newcastle Community Hall
This is to inform Council the members of the above Board heartily
concur with the Newcastle Historical Society's suggestion of re-naming
Newcastle Community Hall .
This suggestion was made in a letter to you dated May 17, 1982.
It was suggested by this Board the new name might be announced at
our Village Heritage Day planned for June 19, 1982.
