REGULATING THE USE OF BICYCLES OUR FILE: 10. 13. 104. RECOMMENDATION: 1. For the consideration of the General Purpose and Administration Committee. BACKGROUND AND COMMENT: On a number of occasions there have been requests made to review the subject by-law for the purpose of improving the Town's ability to address the concerns of the downtown merchants. It would apppear, that during the cycling season, bicycle riders ignore the signs prohibiting the riding or parking of bicycles on the sidewalks. The net effect is, that pedestrian traffic is impeded in the shopping area. Briefly, the subject by-law identifies sidewalks on streets in specific areas of the Town of Newcastle as "sidewalks upon which the riding or parking of bicycles or other vehicles is prohibited. " By-law No. 80-36 also provides that a fine of $5.00 will be levied if a person is convicted of any breach of the provisions of the by-law. Enforcement is not addressed in the by-law and it is the opinion that where the by-law is silent the enforcement is undertaken by the Durham Regional Police Department not Town staff. Continued . . . . . 12 CD-25-82 - 2 - May 17, 1982 IT WOULD BE APPROPRIATE THEREFORE, TO CONSIDER TWO ALTERNATIVES: 1. Pass a resolution requesting that the Durham Regional Police Department undertake a vigorous program of enforcement, or; 2. Consider the by-law as being unenforceable and repeal it.
