THAT Report PS D-l 05-02 be received; and 2. THAT Council concurs with decisions of the Committee of Adjustment made on October 10, 2002 for applications A2002/021, A2002/058, A2002/065 and that Staff be authorized to appear before the Ontario Municipal Board to defend the decisions of the Committee of Adjustment. The purpose of the minor variance applications and the Committee's decisions are detailed in Attachment 1. The decisions of the Committee are detailed below. DECISIONS OF COMMITTEE OF ADJUSTMENT FOR OCTOBER 10, 2002 Application Number Staff Recommendation Decision of Committee A2002/021 Table Tabled A2002/058 Approve Approved A2002/065 Approve Approved 1.2 Application A2002/021 was heard previously in May 5, 2002 at which time the application was tabled by Committee for six months to allow time for the applicant to have a Conservation Authority Board hearing. The Conservation Authority Board hearing, held September 18, granted approval for the detached garage. However, the Health Department has concerns there is insufficient lot area to permit additional lot coverage by a new detached garage and to still allow the septic system to function adequately. Thus tabling was recommended to the next meeting to permit time for the owner to demonstrate to the Health Department that the proposed septic system will function adequately. 1.3 Application A2002/058 was amended at the Committee of Adjustment meeting September 26, 2002 to include an addition to the dwelling that did not meet the exterior side yard setback requirements. The amended application was approved subject to the applicant receiving a building permit within ninety days of the decision. 1 .4 Staff has reviewed the Committee's decisions and is satisfied that the applications that received approval are in conformity with the Official Plan policies, consistent with the intent of the Zoning By-law and are minor in nature 607 REPORT NO.: PSD-105-02 PAGE 3 and desirable. Council's concurrence with the Committee of Adjustment decisions is required in order to afford Staffs official status before the Ontario Municipal Board in the event of an appeal of any decision of the Committee of Adjustment.
