RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration Commillee
recommend to Council the following:
1. THAT Report PSD-085-02 be received;
2. THAT Council concurs with decisions of the Committee of Adjustment made on July 4,
July 25, and August 8, 2002 for applications A2002/006, A2002/007, A2002/025,
A2002l031 to A2002/050, inclusive and that Staff be authorized to appear before the
Ontario Municipal Board to defend the decisions of the Commillee of Adjustment.

a hearing within 30 days of being received by the Secretary-Treasurer, The
purpose of the minor variance applications and the Committee's decisions are
detailed in Attachment No, 1, The decisions of the Committee are detailed

1.2 Application A2002/006 was filed in February 2002 to permit an increase in height
for a detached garage from the maximum of 5 metres to 6,12 metres, measured
from the lowest point of grade adjacent to the building, Committee were not
satisfied that this application was minor in nature nor that the proposed use was
in conformity with the Zoning By-law, Thus, the application was tabled for up to 6
months to allow the applicant time to re-grade the property adjacent to the
detached garage,
At a subsequent hearing on July 4, 2002, the majority of Committee members
had re-inspected the site and were satisfied that the grade had been raised
adjacent to the building and the increase in height now appeared minor in nature,
To ensure the use of the accessory building remains in conformity with the
Zoning By-law Committee included in their decision that the detached garage
was not to be used for business purposes or human habitation,
1.3 Application A2002/007 was filed in February 2002 to increase coverage by
accessory buildings from 40% to 98%. The property was in the process of
changing owners and Committee TABLED the application for up to 6 months to
allow the new owner time decide what to do with the existing accessory

buildings, The new property owner has applied for a rezoning application
(August 2002) to keep the existing accessory buildings and to run a home
industry from these accessory buildings, As the minor variance was no longer
needed, the owner requested the Committee of Adjustment close the application
without prejudice,
1.4 Application A2002/025 was originally heard May 16, then June 6, 2002, to permit
the construction of a detached garage requiring a reduced front yard setback,
westerly side yard setback and separation distance from the main dwelling, The
property is steeply sloped and a significant amount of the lot is zoned
Environmental Protection which constrained the area available to construct a
detached garage, Through discussions with an engineering consultant,
Engineering Services and Planning Services, a resolution was obtained and the
owner was granted approval for a minor variance to locate the detached garage
with a reduced front yard setback and separation distance to the main dwelling,
1,5 After review by the Planning Services Department, Application A2002/031 was
returned to the applicant's as a minor variance was not required, The applicant's
proposal to construct a deck and stairs in the rear yard was achievable, in
compliance with the Zoning By-law, without a minor variance,
1,6 A2002/038 was filed to recognize five accessory buildings and structures totalling
109% of the floor area of the existing dwelling, This application had been
previously applied for in 2001 as A2001/055 and received approval subject to the
applicant obtaining building permits for all accessory buildings and structures
greater than 10 m2 in area (Ontario Building Code), within 90 days of
Committee's decision, The applicant did not apply for or obtain the required
building permits, thus the minor variance lapsed, The applicant was informed the
variance had lapsed and requested to re-apply in March 2002,

The applicant re-applied in June 2002 and was heard July 4, 2002 before the
Committee of Adjustment. At this hearing, the applicant did not attend, or send
regrets prior to the meeting, A number of residents did attend the meeting in
opposition to the applicant. The application was denied at this meeting as it did
not appear the owner intended to obtain building permits and Committee deemed
the five accessory buildings and structures are not in keeping with the
neighbourhood,
A new application has been filed by the property owner at this time and it will be
heard at the September 12, 2002 Committee of Adjustment meeting,
1,7 Application A2002/040 was to reduce the number of parking spaces required
from 119 to 92 to reflect the current uses occupying the industrial building, The
application was TABLED for up to three (3) months to allow time for the owners
to remove outside storage and garbage containers from some of the 92 parking
spaces to ensure that all parking spaces are available for parking, Also, not all
owners had signed the application and the additional time allowed for the
remainder of the applicant's to sign the application as required by the Planning
Act.
1,8 Application A2002/041 was to reduce the required rear yard setback to permit the
construction of a storage building at Roger Swan's Auto on Highway 2 in Maple
Grove, The application was TABLED for up to three (3) months to allow the
applicant time to file a site plan application illustrating the property and the
location of all buildings and structures, and thereby illustrating the need for the
minor variance,
1,9 A2002/045 was an application to permit the construction of an in-ground
swimming pool with an exterior side yard setback of 3 metres instead of the
required 6 metres, A complaint was received from an abutting property owner
regarding altered grading not in compliance with the approved subdivision

grading. A site inspection by Engineering Services and Planning Services
showed that the approved grading had been altered and would allow potential
ponding on neighbouring properties, The application was TABLED for up to 30
days to allow the owner time to correct the grading, The application will be re-
heard by Committee on September 12, 2002,
1.10 Staff has reviewed the Committee's decisions and is satisfied that the
applications that received approval are in conformity with the Official Plan
policies, consistent with the intent of the Zoning By-law and are minor in nature
and desirable. Council's concurrence with the Committee of Adjustment
decisions is required in order to afford Staffs official status before the Ontario
Municipal Board in the even of an appeal of any decision of the Committee of
Adjustment.
