REPORT NO. : TR-34-85 SUBJECT: 1985 RATING BY-LAW RECOMMENDATION: It is respectfully recommended that Council receive -this report and the attached by- law for consideration. BACKGROUND AND COMMENT Council previously approved the 1985 Current Municipal Budget in February under Council Resolution #C-103-85. We have now received the School Boards' levies being: Northumberland/Newcastle Board of Education: Elementary $4,758,729 Secondary 4,847,548 Peterborough, Victoria, Northumberland/Newcastle Ronan Catholic Separate School Board: Elementary $ 363,274 f (s� 2 - TR-34-84 The Region of Durham levy for 1985 as approved by Regional Council is $3,245,280. The Regional Levy by-law has not been approved as yet, pending the receipt of the final apportionment information. Regional staff advise that they do not anticipate any significant change in the apportionment of the levy and therefore, local Council could reasonably approve its own levy by- law based on the Region of Durham budget as presented to Regional Council in March 1985. The change for each 1985 mill rate over the 1984 mill rate which makes up the base mill rate is: Town of Newcastle 2.3 % increase Elementary Public School 6.7 % increase Secondary School 8.2 % increase Elementary Separate School 10.02% increase Region of Durham 3.98% increase The total weighted base mill rate increase for 1984 is 5 .5% for public school supporters. The -total weighted base mill rate increase for 1985 is 6.5% for separate school supporters . The proposed by-law to set the 1985 mills rates is attached for the consideration of Council . WHEREAS, the Council of the Corporation of the Town of Newcastle has, in accordance with the Municipal Act, considered the estimates of the Municipality and it is necessary that the following sums be raised by means of taxation for the year 1985. General Purposes $4,022,390 Area and Special Rates $ 515,302 Regional Purposes $3,007,897 Elementary School $4,634,740 Separate School $ 364,288 Secondary School $4,731,090 AND WHEREAS, the Assessement Roll made in 1984 and upon which the 1985 taxes are to be levied is the latest returned assessment roll, which roll is still subject to revision by the Court of Revision; Residential Commercial Total and Farm and Business Public School $30,068,451 $ 7,988,281 $38,056,732 Separate School $ 2,858,041 $ 210,290 $ 3,068,331 AND WHEREAS, Chapter 302 Section 158 of the Municipal Act RSO 1980, states that the Council of every local Municipality in each year shall levy in the manner set out in the Ontario Unconditional Grants Act, on the whole of the assessment for real property and business assessment according to the last revised assessment roll, a sun equal to the aggregate of the sums adopted under Section 164. THEREFORE, the Council of the Corporation of the Town of Newcastle ENACTS AS FOLLOWS: 1 . That the estimated expenditures required during the year 1985 totalling $23,550,014 less the estimated revenue totalling $6,274,307 leaving a net amount of $17,275,707 to be adopted and the following amounts be levied therefore in the manner as set hereunder: General Purposes $4,022,390 Area and Special Rates $ 515,302 Regional Purposes $3,007,897 Elementary Public School $4,634,740 Elementary Separate School $ 364,288 Secondary School $4,731,090 2. All taxes, including local improvement assessments, shall be deemed to have been imposed and become due and payable on the 1st day of January 1985 but may be paid In four Installments, of which, two Installments will be to receive interim taxes levied under authority of By-Law 74-23, amended by By-Law 80-145. 4. The remaining taxes including local improvement assessments, after deduction of taxes levied prior to the adoption of these estimates may be paid in two installments on the 28th day of June 1985 and 30th day of September 1985. 5. There shall be imposed a penalty for non-payment of taxes on the first day of default of any installment thereof, the amount of 1 1/4% of the amount due and unpaid on the first day of each calendar month thereafter in which default continues, but not after the end of the year in which the taxes are levied, under authority of By-Law 83-38. 6. The Tax Collector is hereby authorized to mail or cause to be mailed the notice of taxes due to the address of the residence or place of business of the person to wham notice is required to be given. 7. All 1985 taxes shall be paid during the calendar year of 1985 at any branch of the Canadian Imperial Bank of Commerce In the Regional Municipality of Durham and Town of Port Hope only. All prior years taxes shall be paid into the office of the Treasurer. - 3 - 8. The Tax Collector and Treasurer are hereby empowered to accept part payment from time to time on account of any taxes due. 9. This by-law shall cone Into force and effect upon the date of the final reading thereof. READ A FIRST AND SECOND TIME THIS 13th day of May, 1985.
