REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE
MEETING OF MAY 6, 1985
REPORT NO.: TR-27-85
SUBJECT: BOWMANVILLE B.I .A. BY-LAW AMENDMENT
RECOMMENDATION:
It is respectfully recommended that the General Purpose and
Administrative Committee recommend to Council the following:
1 . That the attached amending by-law which authorizes the
Bowmanville Business Improvement Area to request a tax
levy up to a maximum $60,000 in any given year be
approved.
2. That the Bowmanville Business Improvement Area be
advised of Council 's action.
BACKGROUND AND COMMENTS:
In preparing the rating by-law for 1985 staff noted that the
current by-law authorizing the levy for the Bowmanville B.I .A.
required amendment. The current authorization level is $40,000.
The Bowmanville B.I .A. has requested a $45,000 levy for 1985.
The limit in the by-law is simply an authorized maximum and the
actual budget is set by the Bowmanville B. I .A. on an annual
basis. It appears prudent to set the authorized limit at a
higher level so that the Town is not annually amending the r
by-law to accomodate a minor variance in the levy request.

This message was communicated to the Bowmanville Business
Improvment Area's Secretary-Treasurer/General Manager and
subsequently a letter was received requesting a change in the
authorized limit. This by-law amendment is required prior to
the approval of the rating by-law. The prior request for an
extension of the Bowmanville B. I .A. area requires time for
advertising, circulation and a period of notice, and therefore,
cannot come forward with this amendment.

Dear Mrs. Campbell
As per our telephone conversation on Friday, April 19 , 1985 ,
concerning our request to change the By-Law to include those
businesses in the area just west of Scugog Road on King Street,
would you be kind enough to include the fact that the Budget
limit should be increased to $60,000 for the annual levy.
This change will provide sufficient latitude for the forsee-
able future to permit our Budget to grow as initiatives are
identified and/or costs increase, without having to seek add-
itional changes in the By-Law to accommodate such changes.
If you have any questions concerning either of these . requests,
please do not hesitate to contact me.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW 85-
being a by-law to amend By-law No. 77-33
of the Town of Newcastle, as amended, by
By-law No. 84-17, and entitled a "By-law
to designate an area in the Bowmanville
Central Business District as an Improvement
Area and to establish a Board of Management
for the Bowmanville Central Business
Improvement Area"
WHEREAS The Council of the Corporation of the Town of Newcastle passed
By-law 77-83 on the 16th day of May 1977;
AND WHEREAS the Council of the Corporation of the Town of Newcastle passed
By-law 84-17 on the 13th day of February 1984, authorizing an increase in
the annual budget of the Bowmanville Central Business District;
AND WHEREAS the Board of Management for the Bowmanville Central Business
District. Improvement Area has requested that the said By-law ,77-33 be
further amended to provide that Council shall not approve any estimates
submitted in an annual budget of the Board in excess of the sum of
$60,000.00;
AND WHEREAS the Council of the Corporation of the Town of Newcastle deems
it adviseable to further amend By-law 77-33, as amended, by By-law 84-17
in accordance with the request of the Board:
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE
HEREBY ENACTS AS FOLLOWS:
1. THAT Section 16 of By-law 77-33 as amended by By-law
84-17 be further amended and the following substituted
therefore:
16. Council shall not approve any estimates
submitted in an annual budget of the
Board in excess of the sum of $60,000.00.
2. This by-law shall come into force and take effect on the
day of enactment.

By-law read a third time and finally passed this day of 1985
