TR-83-44 SUBJECT: ROLL# 1-9-160 - ELMER POLLARD RECOMMENDATION: It is respectfully recommended: 1 . That this report be received; and 2. The Minutes of Settlement be approved; and 3. The Clerk be authorized to sign the Minutes of Settlement on behalf of the Town of Newcastle. BACKGROUND AND COMMENT: It is noted that an appeal was launched against 1982 taxes, and that such appeal was denied by Assessment Review Court on October 29th, 1982. An appeal was subsequently made to The Ontario Municipal Board, and the appeal is now pending before that body. In the meantime, on June 15th, 1983, Minutes of Settlement were reached between the Regional Assessment Commission and the appellant, reducing the assessment to $10,707. from $27,720. for the year 1982. We record below particulars of the property in question: Year Owner Assessment 1979 Goldfan & Newgor R.P. $27,230. 1980 R.P. $27,720. 1981 R.P. $27,720. 1982 Castlecourt Developments R.P. $27,720. & Newgor 1983 " " " R.P. $27,720. The property consists of 63.63 Acres, Con. 3, Part Lot 29. On January 28th, 1983, we received a change of ownership to Elmer Pollard, with whom the Minutes of Settlement for 1982 taxes were reached. . . ./2 (;, - 2 TR-83-44 July 4, 1983 Roll# 1-9-160 - Elmer Pollard We understand that this was sold as development land close to the City of Oshawa in the Courtice Area, with the land being defaulted back to vendor. A study has been done by the Region on the subject property which has found that the number of lots available for building purposes has been considerably reduced, and we therefore recommend that the "Minutes of Settlement" be approved. ELMER POLLARD GROUP 19, BOX 19, R. R. # 3, BOWMANVILLE, ONTARIO. L1C 3K4 WHEREAS the property known as CON 3 PART OF LOTS 29 was valued for assessment purposes for the sum of $27,720 in 1981 AND WHEREAS MR. ELMER POLLARD owner or joint owner or tenant of the property, appealyd to the Assessment Review Court, and the decision of the said Court, dated OCTOBER 29, 1982 was as follows: REALTY ASSESSMENT CONFIRMED. AND WHEREAS an appeal by MR. ELMER POLLARD from the decision of the Assessment Review Court is pending before The Ontario Municipal Board respecting the valuation of the said property. THE FOLLOWING are the Minutes of•. Settlement between the Regional Assessment Commissioner for the Corporation of TOWN OF NEWCASTLE and the owner or joint owner or tenant of the said property: 1) THAT the value, for assessment purposes, be fixed at the sum of $ 10,707 in 1981 for 1982 taxes. 2) THAT it is agreed between the parties hereto that this settlement is for this year only and shall not prejudice either the appellant, the Regional Assessment Cocunissioner or the said Corporation in any other proceeding dealing with the assessment or valuation of this property or any other property used for a similar purpose.
