REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION MEETING HELD ON
MAY 2, 1983.

SUBJECT: NEWCASTLE/OSHAWA BOUNDARY ROAD STREET LIGHTING
RECOMMENDATION:
It is respectfully recommended:
1 . That this report be received; and
.2. That Committee recommend to Council the approval of the
attached by-law which establishes a new street light area
on the Townline Road; and
3. That Committee approves of the general rating of the portion
of the street light costs for that area which abuts farmland
and which illuminates the Taunton Road intersection.
BACKGROUND AND COMMENT:
Subsequent to the approval of the Oshawa/Newcastle Boundary Agreement which
was executed in late 1982, The Town of Newcastle became liable for 50% of
the street lighting costs on the Townline Road. Clause 5.0 to said agreement
is reproduced here for your information.
Clause 5.0
The City and Town agree to share, on a 50:50 basis, the cost of providing
and maintaining a street lighting system along the combined portions of the
boundary road as described in Part I and Part II of Schedule "A" in this
Agreement and along the following portions of the boundary road under the
jurisdiction of the Region of Durham:
a) from Olive Avenue in the City northerly along the boundary to Taunton
Road, a distance of approximately 5.15 km, and
b) from Bloor Street East in the City southerly along the boundary to the
continuation of Regional Road #22 in the Town, a distance of approximately
0.25 km.

The Town of Newcastle's costs of this new street light area are estimated
by the City of Oshawa to be approximately $1 ,000.00 for the 1983 fiscal
year. These costs will be charged to the property owners through a special
street light area rate.
In addition to this new street light area, there are street lighting costs
totalling approximately $700.00 for the Taunton Road intersection and a
southerly portion of Townline Road which abuts farmland in the Town of
Newcastle, which more properly should be a general charge against the
taxpayers of the entire Town. If in the future, the farmland was developed ,
the street light area could be extended to include those lands presently
proposed for exclusion.
This matter arises at this time, because we have only recently been advised
of the costs by the City of Oshawa.

BY-LAW NO.
being a by-law to authorize the Council of the
Corporation of the Town of Newcastle to levy
taxes for street light services on the Townline
Road through a special area tax rate
WHEREAS Section 210(52) of the Municipal Act RSO 1980 provides
that the Municipality may pass a by-law for acquiring, establishing,
constructing, maintenance, and operating a street lighting system; and
WHEREAS the Corporation of the Town of Newcastle has entered into
an agreement with the Corporation of the City of Oshawa which provides
for such street lighting services on the Townline Road:
NOW THEREFORE THE CORPORATION OF THE TOWN OF NEWCASTLE BY ITS COUNCIL
ENACTS AS FOLLOWS:
1. That all properties within the designated street light area as
shown on Schedule "X" attached shall be taxed for 100% of the
cost incurred for street light services.
BY-LAW read a first and second time this day of 1983.
