RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. That Report TR-77-91 be received;
2 . That a purchase order in an amount of $24,952 .40
($26 .50 x 880 linear metres + G.S.T. ) be issued to
Mar King Construction Company Ltd. , Concord, Ontario,
for the Supply and Placing of the Curb and Gutter
at Rudell Road, as required by the Department of
Public Works;
3 . That the procedures set out in the Purchasing By-Law
#82-2, Section 5, Paragraph 04, be waived for this
particular transaction; and
4 . That the funds be drawn from the Public Works approved
1991 Capital Budget, account #7205-91002-0169,
FORTHWITH.
BACKGROUND AND COMMENT•
As outlined in the attached letter marked Schedule "A" , from
Totten Sims Hubicki Associates it is proposed that the placing of
the curb and gutter be awarded to Mar-King Construction Company
Ltd. who were the successful bidders of Contract NW91-6 Beaver
Street. The subject firm have verbally agreed to perform the
work on Rudell Road for the same price per linear metre as what
was included in the Beaver Street Contract. Due to the .
substantial dollar value of the reconstruction of Beaver Street
($+1,000,000.00) the unit prices received are far lower than any
that would be quoted for a much smaller contract such as Rudell
Road should a separate tender be called.

Subsequently, it is therefore recommended that the procedures set
out in the Purchasing By-Law #82-2, Section 5, Paragraph 04, be
waived for this particular transaction.
Funding for the reconstruction of Rudell Road in the amount of
$275,000 .00, a portion of which is for the curb and gutter, will
be drawn from account #7205-91002 as reflected on page 33 of the
approved 1991 Capital Budget from which adequate funds are
available. The balance of the funds allocated will be utilized
for materials (ie. catchbasins, etc. ) and labour by Town forces .
The Treasurer has reviewed the funding requirements and concurs
with the recommendation.' Queries with respect to department
needs, specifications, etc. , should be referred to the Director
of Public Works .
Note, although the attached letter is addressed to Mar-King
Construction Company Ltd. , the original has not been mailed
pending Council approval.
As the reconstruction of Rudell Road has commenced (by Town
forces) , a forthwith approval is requested.
The subject firm have previously performed satisfactorily for the
Town of Newcastle.
