HomeMy WebLinkAboutTR-72-89 i TOWN OF NEWCASTLE u pS REPORT File # Res. # 4 _ By-Law # MEETING: GENERAL PURPOSE & ADMINISTRATION COMMITTEE DATE: September 5, 1989 REPORT #: TR- 2-89 FILE #: SUBJECT: RESERVE FOR ANIMAL CONTROL BUILDING REPLACEMENT RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. That report TR-72-89 be received; and 2. That, the attached by-law which establishes a reserve for Animal Control Building Replacement/Conservation, be approved. BACKGROUND & COMMENTS: In the annual estimates approved by Council for the year 1989, an amount was provided in the Animal Control budget for a transfer to reserves of $7,500.00. This amount was detailed in the Planning and Development Department Capital Budget as transfers to accomodate future replacement of: a) Animal Control Van $3,000 b) Animal Control Building 4,500 7 03 6 Page 2 TR-72-89 RESERVE FOR ANIMAL CONTROL BUILDING REPLACEMENT Although, in accordance with the Municipal Act, Section 164(2) , Council may provide for reserves in the estimates without an accompanying specific by-law, Staff feel it appropriate to document the establishment of all reserves by by-law for future resource reference. MAM/lb 707 The Corporation of the Town of Newcastle By-law 89- being a by-law to establish a Reserve for Animal Control Building Replacement/Conservation Whereas, the Council of the Corporation of the Town of Newcastle considers it desirable to establish a Reserve for Animal Control Building Replacement/Conservation. And Whereas, Section 164(2) of the Municipal Act, R.S.O., 1980, provides that "In preparing the estimates the Council shall make due allowance for a surplus of any previous year that will be avialable during the current year and shall provide for any operating deficit of any previous year, and for the cost of collection, abatement of and discount on taxes and for uncollectable taxes and may provide for taxes that it is estimated will not be collected during the year and for such reserves as the Council considers necessary;" Now Therefore, Be It Enacted and it is Enacted as a By-law of the Corporation of the Town of Newcastle as follows: 1. That the Treasurer be authorized to establish a reserve, entitled Reserve for Animal Control Building Replacement/Conservation; and 2. That the Council may by resolution passed by a majority of members present, direct the use of the funds for specific projects; and 3. That Council may by By-law direct the use of the funds for any other purpose for which it has the authority to spend monies.
