SUBJECT: TENDER T89-13, ONE (1) ONLY BOOM FLAIL HIGHWAY MOWER
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. That Report TR-51-89, be received; and
2. That Marmac, Scarborough, Ontario, with a total bid in the amount
of $44,979.84 being the lowest responsible bidder meeting all
terms, conditions and specifications of Tender T89-13, be awarded
the contract forthwith, to supply one (1) only Boom Flail Highway
Mower, as required by the Town of Newcastle Department of Public
Works; and
3. That the funds expended be provided from the approved 1989 Public
Works Fleet Account.
BACKGROUND AND COMMENT:
Tenders were publicly advertised and six (6) potential bidders invited for the
supply and delivery of one (1) only Boom Flail Highway Mower, as required by
the Department of Public Works.
Subsequently, tenders were received and tabulated as follows:

TENDER T89-13, ONE (1) ONLY BOOM FLAIL HIGHWAY MOWER
With respect to the number of bids submitted, the four (4) other invited
potential bidders have advised that they do not manufacturer this equipment.
A review of the low bid from G.C. Duke Equipment Ltd., revealed that the
equipment proposed does not meet the specifications in several areas. A memo
from Mr. D. Patterson, Manager of Operations, outlining the deficiencies and
their implications is attached marked Schedule "A".
A forthwith approval is requested as this equipment is required for grass
cutting purposes as soon as possible.
After further reveew and analysis of the tender by Public Works and Purchasing
it was mutually agreed that Marmac, Scarborough, Ontario, be recommended for
the contract to supply and deliver one (1) only Boom Flail Highway Mower to the
Town of Newcastle, as required by the Department of Public Works.
The required funds will be provided from the approved 1989 Public Works Fleet
Account, from which there are adequate funds available.
The Treasurer has reviewed the funding requirements and concurs with the
recommendation. Queries with respect to department needs, specifications, etc.
should be referred to the Director of Public Works.
The subject firm have previously performed satisfactorily for the Town of
Newcastle.

MEMORANDUM

SUBJECT: TENDER T89-13
BOOM FLAIL HIGHWAY MOWER
Please be advised that I have reviewed Tender No. T89-13 and
recommend the acceptance of the tender submitted by
Marmac, Scarborough, Ontario, in the amount of $53,247.24
which is not the low tender.
The low bidder was G.C. Duke Equipment Ltd., Burlington, Ontario,
at $44,979.84.
The G.C. Duke Equipment Ltd. bid does not meet specifications of
the tender, particularly Item No.27, hydraulic lift cylinders
shall be mounted on top of Boom arms. Although this is confirmed
in the bid submitted by G.C. Duke Equipment Ltd. in their submission,
but infact their equipment has the cylinder slung beneath the boom
as indicated in a picture on the cover of their brochure.
A hydraulic cylinder located under the boom in this manner would be
unacceptable on this type of installation for the type of use to
which this equipment will be assigned to do. This boom type flail
mower is primarily to be used for reaching into deeper ditches and
embankments for grass cutting and brush clearing. The operator need
only touch a boulder, fence post or guide post or any other obstruction
and damage would be caused to the cylinder which could be dangerous
as well as expensive damage.
Other items that do not meet the specifications are as you pointed out
in your memo of May 17th (48" cutting width rather than a 50" and the
cutter has only 16 knives rather 24) .
In addition to not meeting specification in the areas as described,
the G.C. Duke Equipment Ltd. tractor uses the hydraulic oil reserve
tank as a counter weight which protrudes beyond the width of the
tractor on the left hand side, whereas the Marmac submission has the
oil reserve tank mounted on the interior and the counter weight is
located in the left rear wheel and is flush mounted.

It is our intention to mount a rotating broom on the front of the tractor
early in the spring as an attachment to assist in sweeping up winter
sand. An exterior mounted tank protruding beyond the tracking width
would make operating a rotating broom much more awkward to work close to
curbs and parked vehicles.
Further to the above, Bill Werry, Maintenance Supervisor, was dissatisfied
with the warranty on the previous purchase of a mower from G.C. Duke
Equipment Ltd. in 1987. In that particular case it was a Perfect mower
(purchased by the Tbwn in 1987) and the bearings where deficient and
after repeated attempts to have them replaced under warranty we received
no satisfaction. I have enclosed a copy of the brochure supplied by
each tenderer which clearly shows the problem areas.
I am requesting a forthwith approval on this equipment since we require
it for grass cutting purposes, as soon as possible.
