SUBJECT:
PROPERTY CLEAN UP/MASON, PART LOT 28, CONCESSION 6, DARLINGTON
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. That this report TR-71-88 be received; and
2. That the procedures set out in the Purchasing By-Law #82-92, Section
5, Paragraph 04, be waived for this particular transaction; and
3. That a purchase order in an amount not to exceed $13,000.00, to supply
all necessary labour, materials and equipment to clean up the property
located at Part Lot 28, Concession 6, Darlington, be issued to
Browning-Ferris Industries Oshawa, Ontario; and
4. That the funds expended be provided from the contingency account
#7007-00000-0298; and
5. That in accordance with Section 325 of the Municipal Act, R.S.O. 1980,
all associated costs with respect to the above, be added to the
Collector's Roll and recovered in like manner as Municipal taxes.
BACKGROUND & COMMENTS:
By-Law Enforcement files indicate that the Mason Property has been a
subject of contention for 10 years. Court action and any subsequent
fines have failed to produce any results. Mr. Mason has ignored an
order issued pursuant to Section 31 (7) of the Planning Act. This being
the case, the Corporation now has the right to enter in and upon the
Mason property for the purpose of said clean up.

Subsequently, on--site meetings were held with 2 area contractors to
discuss the proposed clean up of the property. Prices were submitted
as follows;

Browning Ferris Industries Maximum $13,000.00 (could be less)
Oshawa, Ontario
Newcastle Salvage $17,500.00
Newcastle, Ontario
A third contractor, Groeneveld Disposal Services, Oshawa, Ontario were
contacted, however, were not interested.
The Treasurer has reviewed the funding requirements and concurs with the
recommendations. Queries with respect to property should be referred to the
Deputy-Clerk. Due to the nature of the contract staff is recommending that
the contract be awarded as suggested, rather than going out for Tender.
