SUB,JECT: TENDER T88-18, RECONSTRUCTION OF STORM SEWERS AND SERVICES ON NASH
ROAD, ROAD SUBGRADE AND BOULEVARD PREPARATION
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and Administration
Committee recommend to Council the following:
1. That this report be received; and
2. That Wardet Limited, Downsview, Ontario, with a total bid in the
amount of $117,818.00, being the lowest responsible bidder meeting
all terms, conditions and specifications of Tender T88-18, be
awarded the contract FORTHWITH for Reconstruction of Storm Sewers and Services
on Nash Road, Road Subgrade and Boulevard Preparation, as required
by the Department of Public Works; and
3. That the funds be drawn from the 1988 Public Works Capital budget.
BACKGROUND AND COMMENT:
Tender specifications were provided by The Proctor and Redfern Group, for the
Reconstruction of Storm Sewers and Services on Nash Road, Road Subgrade and
Boulevard Preparation, as required by the Department of Public Works.

Tenders were advertised in the local papers, as well as the Daily Commerical
News. Subsequently, tenders were received and tabulated as follows:

Whitby, Ontario
The low bid of $117,818.00 is well within the budget allocation of $242,000.00.
Of the $117,818.0101, $82,449.75 is the Town of Newcastle's cost obligation and
$35,368.25 is the Regional Municipality of Durham's cost obligation.
The estimated fee for the consulting services is $25,010101.0101, which brings the
total required funds to $142,818.001, less the the Region of Durhams portion of
$35,368.25. The engineer's estimate for the project was $183,035.80.
A tentative start date, if approved, would be July 20, 1988 and twenty-one (21)
working days have been allocated for completion.

Although the low bidder has not previously performed for the Town of Newcastle,
they have performed work on several occasions for the The Proctor and Redfern
Group.
A review of the three (3) bids revealed that both the first and third bidders
had assumed a full road closure during the construction period with temporary
access ramps to the dwelling units within the construction area. The second
bidder assumed a one (1) lane only closure with flagman during daytime hours.
The terms and conditions of the tender were that two (2) way traffic must
be maintained at all times. At a meeting on July 11, 1988, with the Purchasing
Agent, the Manager of Engineering, the Director of Public Works and the
consultant, it was mutually agreed that traffic could be detoured during
construction and that a full road closure would be permitted.

The second bidder, Advice Contracting Limited, have confirmed in writing that
the change in the road closure conditions would not reduce their bid to that of
the low bidder. See attached letter marked Schedule "A".
For the information of Council, the large price differential between the first
and second bidder is partially due to the fact that Wardet Limited
are already on site doing the watermain work and would therefore have
substantially less cost involved to move equipment, and prepare for
construction.
The Treasurer has reviewed the funding requirements and concurs with the
recommendation. Queries with respect to department needs, specifications, etc.
should be referred to the Director of Public Works.
After further review and analysis of the bids by Public Works, The Proctor and
Redfern Group and Purchasing, it was mutually agreed that the low bidder,
Wardet Limited, Downsview, Ontario, be recommended for the contract for the
Reconstruction of Storm Sewers and Services on Nash Road, Road Subgrade and
Boulevard Preparation. See attached letter from The Proctor and Redfern Group,
marked Schedule "B".

As per your letter of 1988 07 06 we have reviewed the bids.
As indicated at our meeting of 1988 07 11 at the Town Works Department, we
have contacted all three contractors and we understand from them that:
a) Wardet's tender (Mr. H. Hellwinkle) is based on full road closure during
construction with temporary access ramps to the dwelling units within the
construction area.
b) Advice Construction's (Mr. W. Woosley) bid is based on maintaining only one
lane vehicular through traffic with flagman during day time,
e) Dunedin's bid (Mr. A. Roy) is based on full road closure during construction
with temporary access ramps to the existing dwelling units within the
construction area.
At our meeting of 1988 07 11 the Town Works Department decided to waive the
condition of having the Contractor provide and maintain vehicular through
traffic during construction, and to permit full road closure. One of the reasons
to permit road closure is for traffic safety.
Also Advice Construction when contacted from the Town offices indicated that
they would have no objection to the Town awarding the contract to Wardet (low
bidder) and that they will issue to the Town a letter confirming this.
Thereforev based on the above we recommend the acceptance of the low bidder,
Wardet Limited.

The difference in prices between Wardet's bid and the second bid can be
attributed to the road closure proposal and also, as we understand, Wardet Ltd.
are presently working on Nash Road.
We wish to inform that we have worked with Wardet Ltd. and we found them to
be knowledgeable, perform within schedule and to the satisfaction of all.
Based on Wardet's bid we have prepared a breakdown of the Region's and Town's
cost obligations. (Attached Table No. 1)
As requested we enclose a copy of our estimate which was previously submitted
to the Town Works Department on 1988 06 15.
