(416)263-2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF DECEMBER 7, 1981. REPORT NO. : PD-193-81 SUBJECT: 1. Proposed approval process for the Bowmanville Urban Area Plan. 2. Official Plan Amendment Application No. 81-31/N.B., Glenson Investment Co. Ltd. Recommendations: It is respectfdlly recommended that: 1. This report be received by the Committee; and I 2. That the attached modified Official Plan of the Bowmanville Major Urban Area- Part of the District Planning Area of the Town of Newcastle be forwarded to Council for approval; and 3. That the Region of Durham be requested to approve and to submit the above noted Official Plan of the Bowmanville Major Urban Area, as modified, to the Ministry of Municipal Affairs and Housing for approval as soon as possible; and i 4. That the Region of Durham be advised that the Council of the Town of Newcastle has no objection to the proposed amendment 81-31/NB submitted by Glenson Investments Co. Ltd. and have modified Section 2. 1.2 (iv) of the above referenced plan to permit Council's consideration of the subject pro- posal as well as other similar proposals for higher density residential developments to be located within the Bowmanville Major Urban Area. I i Report No. PD-193-81 Page 2 Background: Staff Report P-107-81, presented to the Planning and Development Committee on July 6th. , 1981, recommended that Council approve a Revised Urban Area Plan for Bowmanville and that Council request the Region of Durham to approve said Plan and undertake the necessary amendments to the Official Plans of the former Darlington and Bowmanville Planning Areas. The recommendations contained in Report P-107-81 were endorsed by the Planning and Development Committee on July 6th. , 1981 (resolution No. PD-249-81) and on July 13th. , the recommendations adopted by Council. Although the recommended request for approval was related to making amendments to the Bowmanville and Darlington Official Plans, this was considered a temporary measure as the Bowmanville Urban Area Plan had been prepared to form an integral portion of Part II to the District Plan for the Town of Newcastle. Part I was to be an overall Plan, which reaffirmed the applicable policies of the Durham Regional Official Plan. This approach reflected direction and guidelines provided by the Ministry of Housing at that time, and although the idea of a 3 Part District Plan has certain merit, Town Staff have, at various stages, had difficulty rationalizing the need for the repetition contained within the Part I District Plan, given that the content and level of detail was so similar to the Regional Official Plan. Planning Staff have recently discussed the District Plan concept with Ministry and Regional Planning Staff and it now appears that the Ministry of Housing and Municipal Affairs, and the Region of Durham are prepared to consider the approval of the Bowmanville Urban Area Plan as the Official Plan of the Bowmanville Urban Area - Part of the District Planning Area for the Town of Newcastle. As outlined in L. Kotseff's(Regional Planning Manager) letter to J. Malcolm, Ministry of Municipal Affairs and Housing, this approach would eliminate the cumbersome task of attempting to amend ( the existing Official Plan(s) . (see letter attached) This approach would also require the Town to revaluate earlier efforts aimed at preparing an overall District Plan for the entire Town. Comments: Staff feel that our recent discussions with Ministry and Regional Staff have led to the acceptance of a procedure which will streamline the Planning process. This approach does, however, require that minor changes in foremat be incorporated into the Bowmanville Urban Area Plan. The required changes are minor in nature and in many cases, simply delete references to the Part I Plan. These changes have been incor- porated into the Revised Plan, attached to this report, and have been itemized on Appendix I. Report No. : PD-193-81 Page 3 In addition, staff are suggesting that several other alterations be made to the Plan to address comments raised during the Region's circulation of the Plan, and to address certain other matters that have come to staff's attention since the Plan was adopted by Council in July. These changes are also itemized in Appendix I and have been incorporated in the Revised Plan. Appendix I also provides a brief discription of the rationale behind each of the suggested changes. Most noteworthy of the suggested changes are those that relate to residential densities and which were initiated by a development application by Glenson Investments Co. Ltd. (Official Plan Amendment Application 81-31/NB; Rezoning Application ZA-2-12-6. See copy of Report PD-177-81, attached) The suggested alterations would allow Council to consider residential densities in excess of 80 unit per hectare maximum if they were satisfied that the site and neighbourhood characteristics were suitable for the proposal and that there was sufficient servicing capacity to accomodate the proposal without adversely affecting the development potential of other lands. The suggested changes, as outlined in Appendix I, and included in the text, would allow Council more flexibility in considering higher density residential developments. Each proposal would be considered on its own merits and could only proceed on the basis of a site specific zoning by-law amendment. It would now be appropriate for Council to forward these further modifications to the Region of Durham for their consideration and approval as part of the Official Plan for the Bowmanville Major Urban Area. NATURE OF SUGGESTED CHANGE 1.2 all references to the 3 Part District Plan are deleted 1.3 all references to the 3 Part District Plan are deleted 1.3.2(1) a technical error has been corrected by changing a reference to Schedule "Al" to Schedule "lA". 1.3.2 (iv) the word "Roads" has been replaced by the words "transportation network" to reflect the addition of a "possible Transit Services Alignment" on Schedule4. 2. 1.2 (i) c) a reference to the Part 1 District Plan has been deleted and a typographical error has been corrected by changing the target population from 42,000 to 43,200, as shown on Schedule 1. 2.1.2 (iii) a) a reference to the Part 1 District Plan has been deleted. 2.1.2 (iii) b) reference to the Ministry of Housing is changed to Ministry of Municipal Affairs and Housing. 2.1.2 (iii) e) Minor rewording changes have been made to clarify the intent of the Section. 2.1.2 (iv) c) Changes to this section relate to providing Council with additional flexibility to consider residential development of a higher density thani;the general guideline of 80 units per hectare. 2. 1.3 (ii) the word "by" in the fifth line has on the request of C.L.O.C.A. been replaced with the words "by or under the direction of " 2.1.3 :(iii) a change in wording has been made to reflect current legislation related to site plan control. 2.1.3 (iv) a reference to the Part I Plan has been deleted 2.1.3 (viii) This section has been added to address a concern raised by C.N. Rail related to vibration and noise. 2.2.3 This section has been deleted to remove a potential burden on the Municipality and to be consistent with the approach taken in the Courtice Urban Area. 2.3.2 (i) c) a reference to the Part I Plan has been deleted. Appendix 1 Page 2. 2.3.2 (v) a) this section has been reworded to be consistent with the suggested change in Section 2.2.3 2.4.2 (i) the word "by" in the forth line, has, on the request of C.L.O.C.A. been replaced with the words "by or under the direction of". The second paragraph has been added at the request of Ontario Hydro. It serves to clarify the intent of the Section. 2.5.2 (i) e) i) a technical error has been corrected by deleting two references to a floor space index of 1.75 and replacing with the correct index of 2.50. 2.5.3 (i) a change in wording has been made to reflect current legislation related to Site Plan control. 2.5.3 (ii) a reference to the Part I Plan has been deleted. I 2.5. 3 (iv) a reference to the Part 1 Plan has been deleted. 2.6. 3 (i) a change in wording has been made to reflect current legislation related to Site Plan Control. 2. 7.2 (vi) a minor wording change has been made to clarify the intent of the section. 2.7.2 (ix) the section dealing with Public Transportation has been enlarged to cover certain items which were formerly in the Part I District Plan. 2.9 and 2. 10 Section )2.9 and 2. 10 have been added to provide policy related to Historic Conservation and Energy Conservation. These Sections were formerly included in the Part I District Plan 3.4.2 a reference to the Part I District Plan has been deleted in both the indroductory portion and in part (vii) 3.6 a minor change in wording has been made to clarify the intent. Schedule 1 Schedule 1 has been amended by: -altering slightly the Hazard Land boundaries in the vicinity of Base Line Road (on the request of C.L.O.C.A.) -rearranging the community facilities within Neighbourhood 3 to bring the Schedule in line with the neighbourhood concept for this area. -removing the note which referred to Durham Official Plan Amendment # 24. Appendix 1 Page 3 Schedule 4 Schedule 4 has been amended by adding the "possible Transit Service Alignment" as per the Durham Regional Plan. Schedule 4 has also been amended by deleting the note which referred to Durham Official Plan amendment # 24. i i
