REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF
OCTOBER 26, 1981.

SUBJECT: Application for Rezoning Z-A-1-9-3
Part of Lot 28, Concession 3,
former Township of Darlington
- Neil Ryan.
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:-
1) That Report PD-175-81 be received; -
2) That application for rezoning Z-A-1-9-3 be denied
and the application be considered premature at this
time as services are not available to the subject
lands.
Background:
I
The subject application requests an amendment to Restricted
Area (zoning) By-law 2111 of the former Township of Darlington to re-
zone a 2048. 8 square meter (22,053 square feet) parcel of land fronting
on Courtice Road and within the limits of the Courtice Urban Area.
The applicants intend to rezone their property in order to permit the
severance of one additional residential building lot from their
holdings.
The site is designated "Residential Areas" in the Region of

Durham Official Plan and in the Darlington Official Plan, as amended,
by Amendment No. 12, the Courtice Urban Area Plan. Section 8. 1.3. 1 of
the Durham Official Plan requires that residential areas be fully
serviced by municipal water and sewage systems and that this shall
be a necessary condition before residential development is permitted.
In addition, Section 6.1.3 (iv) of Amendment No. 11, the Courtice
Urban Area Plan, would permit infilling on full municipal services
and having frontage on an existing road. Staff have been advised
by the Region of Durham Planning and Works Departments that municipal
services are not available to the subject lands, and that there are

no plans for extending services to this area at the present time.
In this regard, the proposed rezoning to permit the creation of an
additional residential lot would not conform with the policies of the
Region of Durham Official Plan or the Darlington Official Plan.
In accordance with Departmental procedures, the subject
application was circulated to the following agencies/departments
for comments.
The Region of Durham Planning Department:
"Please be advised that the proposal which would facilitate
a severance and permit a single family dwelling on private
services is not in conformity with the Durham Plan. Section
8. 1.3.1 of the Plan requires that residential areas be fully
serviced by municipal water and sewage systems. In this
regard, the proposal would be considered to be in conformity
if a provisions was included in the amending by-law requiring
that new development take place on full municipal services."
The Region of Durham Works Department:
"Please be advised that municipal water and sanitary services
are not available to the subject site and the Region has no
plans to extend services into this particular area of the Town."

The Durham Regional Health Unit:
"There is insufficient land area on the proposed lot to
accomodate septic tank disposal systems which would meet
present day standards. Should the existing system on lot
A malfunction in future, there is inadequate area for a
replacement system.
The Durham Regional Health Unit, therefore, does not re-
commend approval of this application."
The Newcastle Works Department:
"no objection"
The Newcastle Building Department:
"no objection"
The Newcastle Fire De artment:

"The Fire Department has no objection to the proposed re-
zoning application. The proposed lots are located within
12 miles of existing Fire Station 4, Courtice with a response
time of approximately 8 minutes."
Comments:
Staff have reviewed the application submitted by Mr. N. Ryan
and note that the proposal does not conform with the policies or
the intent of the applicable Official Plans which require residential
development within the Courtice Urban Area to proceed on the basis of
full municipal services. We also note the comments of the Region of
Durham and the Health Unit which indicate respectively, that services
are not to be extended to this area in the foreseeable future and that
the proposed lots have insufficient area to accommodate private services.
For the foregoing reasons staff have no alternative but to
consider the subject application as premature at this time due to
a lack of servicing.
