REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING
OF OCTOBER 13, 1981.
REPORT NO. : PD-170-81
SUBJECT: Application for Rezoning Z-A-1-15-7
Part of Lot 18, Concession 7, former
Township of Darlington. Wm. Henderson
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:-
1. That report PD-170-81 be received; and
2. That staff Report P-83-81 be lifted from the table and
the following resolution in respect of the above adopted:
"WHEREAS the Council of the Town of Newcastle in
considering application for rezoning Z-A-1-15-7 did
on May 19, 1981, deem it appropriate to table
consideration of this matter pending a meeting between
the Town's Site Plan Committee and the applicant Mr. Henderson;
AND WHEREAS the applicant has repeatedly failed to
comply with Town staff's requests to schedule such a

meeting with the Site Plan Committee;
THEREFORE be it resolved that Council hereby denies
application for amendment to Restricted Area By-law 2111,
as amended, as requested by Mr. William Henderson,
file Z-A-1-15-7 affecting Part of Lot 18, Concession 7,
former Township of Darlington, due to failure to
negotiate a Site Plan Agreement.

BACKGROUND AND COMMENT:
On May 11, 1981 the Planning and Development Committee
considered Staff Report P-83-81 (attached) in respect of the
above. The recommendation contained in Report P-83-81 was that
the subject application for rezoning be denied as the applicant
had failed to enter into a Site Plan Agreement with the Town.
However, Resolution #PD-169-81 adopted by the Planning Committee
stated "that Report P-83-81, Henderson Rezoning Z-A-1-15-7 be
tabled pending a meeting between the Site Plan Committee and
Mr. Henderson."
By letter dated May 29, 1981, from the Director of Planning,
the applicant was advised of the Planning Committee's recommendation.
Subsequent conversations between Planning Staff and the applicant
indicated an unwillingness to proceed with the Site Plan Agreement.
Therefore, since there has been no positive indication from
Mr. Henderson of his intentions to proceed with this matter any further,
and the fact that the Site Plan Agreement is required prior to the
final rezoning of his lands; we respectfully suggest that this file be
closed and the application for rezoning be denied.

RECOMMENDATIONS:
That the Planning and Development Committee recommend to Council
the followi nt;
1. Thai: Report P-83-81 be received; and that
2. Application by Mr. William Henderson for rezoning, file
Z-A-1-15-7 affecting Part of Lot 18, Concession 7, former i
Township of Darlington be denied due to failure to negotiate
a Site Plan Agreement and the applicant be advised.
BACKGROUND & COMMENT:
I
On January 5, 1981, Planning Committee considered staff report
P-5-81 (attached) . The report recommended approval of an amendment
to By-law 2111, as amended, to .legalize an existing illegal butcher shop
located on Regional Road 3 in Enniskillen. The proposed By-law amendment

was to be forwarded to Council for approval at such time as a Site Plan
Agreement had been entered into with the Town.

On January 14, 1981 the applicant, Mr. William Henderson,
was advised of the Town's requirements by Mrs . G. Gray. In addition,
on February 4, 1981 a letter from this Department further advised the
applicant of the Town's requirements and forwarded copies of the necessary
application fonns .
As them leas been no indication from Mr. Henderson that lie wishes
to proceed further with this application and the fact that the require-
ments of By-law 79-151 (Site Plan Control By-law) are applicable to this
application and must be complied with, we respectfully suggest that this
file be closed and the application for rezoning be denied.
