(416)263-2231 REPORT TO THE GENERAL PURPOSE AND ADMINISTRATION COMMITTEE MEETING OF OCTOBER 13, 1981. I REPORT NO: PD-168-81 SUBJECT: Application for Rezoning - D.R. Agencies (Oshawa) Ltd. , Part of Lot 32, Concession 2, former Township of Darlington. File: Z-A-1-6-8 i i RECOMMENDATIONS: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following:- 1. That Report PD-168-81 be received; and 2. That application for rezoning Z-A-1-6-8 be approved; and 3. That the attached By-law 81- be forwarded to Council for approval. BACKGROUND: The subject application requests an amendment to Restricted Area (Zoning) By-law 2111 of the former Township of Darlington to I rezone a .80 hectare (2.0 acre) parcel of land located in Lot 32, Concession 2, Darlington. The amendment would permit the development i of up to 8 residential lots, which have been given conditional approval I by the Durham Region Land Division Committee. (Applications LD 318/81 to LD 325/81) . i The site is designated "Residential Areas" in the Region of Durham Official Plan. The proposed residential uses are permitted. i - 2 - In addition, the Regional Plan requires that residential development must be fully serviced by municipal water and sewer, prior to development of this nature proceeding. However, staff have been advised by Region of Durham Works that services are available and may be extended to the subject lands. Therefore, the proposal would conform to the Durham Official Plan. The site is presently zoned "G - Greenbelt" and "D - Deferred Development" by Restricted Area (Zoning) By-law 2111 of the former Township of Darlington. The proposed By-law amendment would apply a "special provision" to this site in order to permit the proposed residential development. In accordance with departmental procedures, the subject application has been circulated to various departments and agencies 1 for comment. The following comments were received:- The Durham Planning Department "Please be advised that the subject site is designed "Residential" in the Durham Regional Official Plan. The proposal which would facilitate a number of severances and the construction of 8 single family dwellings, conforms." The Durham Works Department "With respect to Regional services, both water and sewers are available to the site. Regional requirements have been secured by means of conditions of severance." The Newcastle Public Works Department "That the rezoning be granted and that the Applicant enter into a Development Agreement suitable to the Public Works Department, for the servicing of the subject lands. " (Planning Staff note that this requirement will be dealt with through clearance of the conditions of severance.) The Newcastle Fire Department "The Fire Department has no objection to the proposed application for rezoning. The area is located approximately 2 miles from fire station A. Courtice, which is an acceptable response distance. Water supply for fire protection, although it is a very small number of dwellings located on an existing road allowance, a fire hydrant should be installed within 350 feet of buildings to be protected." 3 - The Central Lake Ontario .Conservation Authority "The Authority has no objection to the approval of the rezoning application as it pertains to the 8 lots created by severance. The area abutting the small watercourse at the northern end of the subject lands should be zoned "Greenbelt". " The Ministry of Natural Resources "We note that while the related land severances applied to upland properties, this rezoning application includes the floodplain of a small tributary of the Farewell Creek. The drainage basin of this tributary is less than z square mile and, therefore, the potential for flooding is not high. However, the applicant should be made aware that a low flooding potential exists on low lying lands adjacent to the creek. Furthermore, we would appreciate your assistance in advising the applicant that no damming or other alteration to the creek be carried out without prior written authorization from the Ministry. We have no objection to the rezoning application." Comments: Staff have reviewed the subject application submitted by D.R. Agencies (Oshawa) Ltd. and would have no objection to the approval of the application. In addition, staff note that the proposal conforms to the policies of the Durham Regional Official Plan and is also in conformity with Amendment 12 of the Darlington Official Plan. However, it should be noted that staff have requested several conditions of severance which the applicant must fulfill. These are as follows:- 1) that 5% cash-in-lieu of parkland be paid to the Town; 2) that the applicant satisfy Durham Regional Works with regard to municipal services; 3) that the applicant satisfy the Town's requirements financial and otherwise; 4) that the applicant prepare and file a reference plan for the purposes of describing the subject lots; 5) that the applicant construct to Town of Newcastle specifications, the east-west local road connection to the lands to the east; - 4 - 6) that the applicant dedicate to the Town a one foot reserve across the east limits of the east-west local road connection; 7) that the applicant pay to the appropriate party his share of all development costs associated with the construction of Windsor Valley Place, and the municipal services associated therewith; 8) lifting of the existing one foot reserve along the frontage of Windsor Valley Place; and 9) that the lands be rezoned to an appropriate zoning classification. As this application for rezoning forms part of the Town's conditions for severance and the Land Division Committee requires the applicant to satisfty the Town's requirements, approval of this application will facilitate clearance of those conditions of severance and we would have no objection to the approval of the attached by--law.
