SUBJECT: Proposed Site Plan Agreement
Kenoyd Ltd.

RECOMMENDATION:
It is respectfully recommended that the Planning and Development
Committee recommend to Council the following:
1) That Report P-164-81 be received; and
2) That the attached Site Plan Agreement between the
Town and Kenoyd Ltd. , be approved for execution;
and
3) That the attached by-law authorizing the execution
of a site plan agreement between the Town and
Kenoyd Ltd. , be approved.

BACKGROUND:
On August 10, 1981, staff received the above noted application
for site plan approval. The applicants, Kenoyd Ltd. , are proposing the
construction of an industrial building on a 0.43 ha (1.06 ac) site
located on the south-east corner of Baseline Road and Simpson Avenue in
Bowmanville. The site is designated as industrial by the Durham Regional
Official Plan and the Bowmanville Urban Area Plan and zoned M-1 Industrial
by Restricted Area By-law 1587, as amended.

COMMENTS:
In accordance with the Department's procedures, the application
was circulated to the members of the Town's Site Plan Committee and
various other agencies for review and comment. There were no objections
received as a result of the circulation and the minor concerns which
were identified have been addressed through the terms of the site plan
agreement.
The attached agreement and site plan have been reviewed by
staff and we have no objection to their approval. The applicant has
submitted five signed copies of the completed agreement for execution
and it would now be appropriate to forward same to Council for authorization
to execute.

By-Law Number 81--
Being a by-law to authorize the entering
into an Agreement with Kenoyd Ltd.
The Council of the Corporation of the Town of Newcastle ENACTS
AS FOLLOWS:-
THAT the Mayorand Clerk are hereby authorized
to execute on behalf of the Corporation of the
Town of Newcastle and seal with the Corporation
Seal an Agreement between Kenoyd Ltd, and the
Corporation dated the day of
A.D. 1981, which is attached'
hereto as Schedule "X".
BY-LAW READ a first and second time this day of 1981.
