SUBJECT: Proposed Amendment to By-law 76-25

RECOMMENDATIONS:
It is respectfully recommended that the Planning and Development
Committee recommend to Council the following:-
(1) That Report P-163-81 be received; and that
(2) The attached amendment to By-law 76-25, as amended,
be forwarded to Council for approval; and

(3) That an exemption be granted from Section 4(3) (b) of
the Sign By-law as requested by J. VanGinhoven.

BACKGROUND:
On August 31, 1981, staff received a request from Mr. J.
I
VanGinhoven, that the Town consider an amendment to the sign by-law
to permit the alteration of an existing sign on the north west corner
of the intersections of Taunton and Old Scugog Roads. The proposed
alterations are required to facilitate a change in the service station's
represented Oil Company. Section 12(4) of the Sign By-law requires
municipal approval of plans and issuance of a si gn permit prior to

erection or alteration of any sign. For the purposes of the by-law
"alteration" is defined as a change to any of the names, symbols or
devices on such sign.
Upon examination of the proposed alteration it was determined
that the sign to be altered was actually within the limits of the
road allowance of Taunton Road. For that reason a sign permit could
not be issued and the subject request for a by-law amendment submitted.
On September 1, 1981, the applicant submitted plans to the
Planning Department indicating a proposed relocation of the sign to
within the property boundaries, but still contrary to the sign by-law
since the new location would be within the sight triangle of the
aforementioned intersection. In addition, a special resolution of
Council would be required pursuant to Section 4(3)(b) of the Sign
By-law since the proposed illuminated sign contains the colours green,
yellow and red and would be located within 25' of the street line.
COMMENTS:
Staff have reviewed the proposed location of the sign with the
applicant and the implications of locating the sign in accordance with
the By-law requirements. It would appear that such a location would
severely hinder the movement of vehicles attempting to utilize the
service station's fuel pumps and also reduce the amount of space
presently available for on-site parking. On the other hand the present
location of the existing sign, within .the road allowance, is not
acceptable nor desireable and should not be perpetuated. In that
regard, we have discussed the optimum placement of the sign with
Mr. VanGinhoven bearing in mind the need to ensure an adequate sight
triangle, and have determined a location which would be acceptable to
both staff and the applicant as indicated on the attached sketch plan.
The suggested location would slightly reduce the amount of available parking,
provide an additional landscaped area and would ensure that the sign is
located entirely on-site. The design of the sign is such that it would
not significantly obstruct sight lines and would, in fact, be an
improvement over the existing sign which, combined with two phones in the
Regional Road Allowance, contributes considerably to the existing problems

with sight lines at this intersection.
As a result of our review of the subject request, it has also
come to our attention that other on-site changes, of municipal concern,
were being contemplated by the applicant. These include an alteration
to an existing access which would remove existing landscaped areas and
changes to the existing surface drainage, which would increase run off
problems on Old Scugog Road. In addition, it was determined that the
applicant had, in 1979, altered without authorization a third access to the
subject property from Old Scugog Road. In this regard, staff of the
Work's Department have indicated that they would have no objection to
the proposed alterations and that pursuant to the Town's Entrance
Policy, permits would be required for the proposed alterations and to
approve the unauthorized access if so desireable. In conjunction-with
the Work's Department review of access permits the adequacy of the present
storm drainage will be reviewed, the implications of the proposed changes
to the site's grading and drainage upon off-site drainage assessed and
remedial measures recommended, to be undertaken in connection with any
changes to the site's access.
While these two matters, signage and access, are not directly
related, staff are unwilling to recommend approval of an amendment to the
sign by-law while the Town's concerns over other aspects of this site's
development require attention. We would note, however, that as a result
of our review these matters have been brought to the applicant's
attention and the required access permits applied for. We are also sug-
gesting thatrelocation of the sign, incorporate the provision of a curb and
landscaped area around the base of the sign to replace landscaping being
removed in other areas, and to clearly define the limits of vehicular traffic
areas, thus reducing the problems of cars parking within the intersection's
sight triangle. 1-

Being a by-law to amend By-law No. 76-25,
as amended, of the Corporation of the Town
of Newcastle.
NOW THEREFORE the Council of the Corporation of the Town of
Newcastle ENACTS as Follows :-
1. Section 11 of By-law 76-25, as amended, of The
Corporation of the Town of Newcastle is hereby
further amended by adding thereto the following

"SPECIAL CONDITION 7":-
SPECIAL CONDITION 7
7.1 Defined Area
The lands subject to this SPECIAL CONDITION
comprises part of the south half of Lot 16,
Concession 5, of the former Township of
Darlington situate on the north-west corner
of the intersection of Durham Regional Road 4
and Old Scugog Road bounded by Durham Regional
Road4on the south, Old Scugog Road on the east
and north and the east limit of Lot 17,
Concession 5 on the west.
7.2 Permitted Signs
Notwithstanding any provision of this By-law to
the contrary, a ground identification sign
associated with the uses permitted within the
"Defined Area" may be located within the sight i
triangle of the intersection of Durham Regional
Road 4 and Old Scugog Road provided that said
ground sign shall not overhang either of the

aforesaid road allowances, shall be located no
closer than ten (10) feet from the intersection

of the street line of Old Scugog Road with the

streetline of Regional Road 4, no closer than
two (2) feet from the street line of Durham
Regional Road 4, and shall have a minimum clearance
of eleven (11) feet between the base of the sign
and the surface of the ground.
2. This By-law shall come into effect on the date of the final
passing hereof.
