(416)263-2231 REPORT TO THE SPECIAL MEETING OF COUNCIL AUGUST 21, 1981 REPORT NO. : P-152-81 SUBJECT: Application for Rezoning - Durham Regional Police Part Lot 15, Con. 1, former Township of Darlington Our File: Z-A-1-2-6 RECOMMENDATIONS: It is respectfully recommended that the Planning and Development Committee recommend to Council the following: 1. That Report P-152-81 be received; and 2. That application for rezoning Z-A-1-2-6 be approved; and 3. That the attached By-law be forwarded to Council for approval concurrent with the execution of i the Development Agreement referred to by staff in Report P-152-81. BACKGROUND: The subject application requests an amendment to I Restricted Area (Zoning) By-law 2111 of the former Township of Darl- ington to rezone a .8 hectare (2.0 acre) parcel of land located in Lot 15, Concession 1, Darlington. The amendment would permit the construction of a Police Station on the said lands. i i 2 - The site is designated "Major Open Space" by the Region of Durham Official Plan. Generally buildings of this nature are not permitted under this land use designation. However, Section 6.2.6 of the Plan would permit Council of the area municipality to zone to permit police stations, fire stations, public parks, etc. , in any land use designation, provided that such use and/or facility is compatible with abutting land uses. In this regard, the proposal would appear to conform with the policies of the Regional Plan. r The site is presently zoned "Agriculture" by Re- stricted Area (Zoning) By-law 2111 of the former Township of Darlington. The proposed By-law would apply a "special provision" to this site in order to permit construction of the proposed Durham Regional Police Building. In accordance with departmental procedures, the subject application has been circulated to various departments and agencies for comment. The following comments were received: The Durham Planning Department "Please be advised that Section 6.2.6 of the Durham Regional Official Plan states that: Notwithstanding any other pro- visions in this plan to the contrary the Council of the respective area municipality may recognize in the restricted area zoning by-law, police stations. . .in any area, having first been satisfied that the proposed facility is compatible with its surroundings. In determining land use compatibility, the Council of the respective area municipality shall have due regard for the provisions of this plan as they apply to the land use designation for the area in which the facility is to be located. In particular, facilities which would unduly restrict or conflict with the predominant permitted land use shall not be encouraged." The Durham Works Department and Health Department "Municipal water supply and sanitary sewers are not available to the subject site and the Durham Works Department has no plans to extend services to this area. However, the Durham - 3 - Regional Health Unit has indicated that it has no objection to the proposal proceeding on the basis of private services. With respect to abutting Regional Road No. 57, the proposal would not appear to have any significant adverse effect." The Newcastle Public Works Department "1) That the applicant enter into a Site Plan Agreement. 2) That property access be from Durham Road 57. 3) That the applicant indicate by means of grades and direction of flow arrows how storm run off from the unopened road allowance between Concessions 1 and 2 will be discharged. (Staff note that the topography of the unopened road allowance is such that run off flows to an existing tributary of the Bowmanville Creek. It is because of the topography that the afore- mentioned road allowance has never been open. In any event, the request is in respect of lands external to the site and not relative to the site's development.) 4) That the owners agree to grub and clear that section of the unopened road allowance abutting the said property." (Staff note, as above, that this road allowance crosses a tributary of the Bowmanville Creek. In that regard, it forms a part of the valley system and should be retained in a natural state for environmental reasons. Furthermore, the road allowance is external to the site and not relative to the site's development.) The Newcastle Fire Department "I would note that there is no municipal water supply for fire protection, which is of some concern but not critical. Any major development within the area should require a piped water supply system for fire protection. There appears to be considerable elevation from the road allowance to the station site, inadvertently affecting future installation of a piped water system. (Staff note that since the subject site is outside of a designated Urban Area, as delineated by the Durham Regional Official Plan, full municipal services are not a prerequisite to development. In fact, the Regional Works Department has indicated that the Region does not plan to extend services to this area.) However, access for fire emergency vehicles appears to be ade- quate." The Newcastle Building Department "no objection" - 4 - COMMENT: Staff have reviewed the comments received through circulation and would note that there are no significant concerns in respect of this development. With regards to the land use compatibility, we note that the predominant use of land abutting this site is for agri- cultural purposes, therefore, a proposal of this nature would appear to have no adverse effect on the abutting uses in the area. For this reason, and the fact that the proposal conforms to the policies of the Region of Durham Official Plan, staff would have no objection to the approval of this application. In addition, staff note that all other matters relative to this proposal have been dealt with through the provisions of the site plan agreement. Respectfully submitted, m jp EP:lb D. N.
