REPORT NO. : P-149-81 i SUBJECT: Request by Suncor (Sunoco Group) for an exemption from the provisions of the Sign By-law - Sunoco Service Station, 96 King Street East, Bowmanville Our File: 8.1.9 j RECOMMENDATIONS: It is respectfully recommended that: 1. This Report be received; and 2. That the Planning and Development Committee recommend to Council approval of a further exemption from(Section 43 (b) of)the, Sign By-law as requested by Sunoco Inc. BACKGROUND: i At the Planning and Development Committee meeting of July 20, 1981, Committee considered Staff Report P-137-81 (copy attached) and recommended that an exemption be granted to allow for the erection of a sign on the site of the Sunoco Station at 96 King Street East, in Bowmanville, which did not comply with the colour requirements of the I existing Sign By-law. The recommendation of the Planning and Development Committee was accepted by Council on July 27, 1981. `S' �__ U d �,9 I 2 - COMMENT: Subsequent to Council's consideration of Sunoco' request for an exemption to the Sign By-law on the 27th of July, 1981; Staff have met with Mr. R. E. Doran, on behalf of Sunoco, in respect to the size requirements in the Sign By-law as they would pertain to this site. Mr. Doran has indicated that Sunoco Inc. would like to erect a sign of forty square feet on the property, which would be similar in size to the existing sign on the service station property. The Sign By-law as it applies to the property would permit a sign of thirty square feet in maximum area thereby requiring a further exemption for this proposal. Mr. Doran indicated that the Suncor Group is attempting to standardize its signs and cannot economically reduce the size of the proposed sign any further. Staff agreed that the forty square foot sign would not be a serious deviation from the provisions of the Sign By-law in this instance and are hereby recommending that a further exemption be granted to Sunoco for the erection of a sign of forty square foot maximum size. The Planning an4 Development Committee recommend to Council approval of an exemption from Section 4(3) (b) of the Sign By-law as requested by Sunoco Inc. BACKGROUND: A request has been made to Council for an exemption from the .provisions- of. the Sign By-law of the Town of Newcastle (copy attached) to permit the erection of a pylon sign in front of the existing Sunoco Service Station located at the corner of King and George Streets in Bowmanville. This request has been referred to the Planning and Development Committee for a recommendation. 2 - The proposed identification sign is permitted in the "Commercial" zone in Bowmanville. However, the proposed sign is to include the colours of red and amber, which are not permitted by the By-law. Section 4(3) (b) of the Sign By-law states that "no illuminated sign which uses the colours red, green or amber shall be located within 150 feet of a traffic control signal nor within 150 feet of an intersection of two or more streets, except by Special Resolution of Council. This provision shall not apply to signs located more than 25 feet from any street line. " COMMENTS : Staff have reviewed the request by Suncor and would have no objection to exempting this particular sign from Section 4(3) (b) of the Sign By-law subject to compliance with all other provisions of the sign by-law (sign area) . In addition, staff have reviewed correspondence from the Chief Building Official which indicates that the proposed colours of the sign would be unlikely to be mistaken for a traffic signal, or, cause any confusion with traffic signals, if installed at this corner in the future. Attention: Mr. David Oakes, Town Clerk Dear Sir: re: Sunoco Service Station 818-1 lLE . . . . . . . . . . . . . . . .. . . 96 King St. E. @ George, Bownanville Please find attached two prints of Site Plan Drawing No. 67-37P, REvision 1, and two prints of Pylon Sign Drawing No. PS-2, Revision 1, along with an 8" x 10" photograph showing the pylon sign which we wish to erect on the subject property. Apparently the erection of this sign will be in violation of Section 4, Sub-section 3(b) of Bylaw No. 76-25. This bylaw, in effect, restricts signs using the colours red, green, or amber within 1SOft. of a traffic control signal or within 150ft. of an intersection of two or more streets, except by special resolution of Council. The location of this pylon sign has been considered at great length by our Retail Design people. The location of the sign at the west side of the property will render it ineffective as there will be no visibility for eastbound traffic. Another consideration was to locate it between the two entrances (in the area of the existing pump islands) . However, there is insufficient space to allow the sign location here. The most practical location for our sign would be as shown in the attached Site Plan Drawing. I would, therefore, request that the Town give consideration to an exemption from Section 4, Sub-section 3(b) of the Sign Bylaw, and permit the use of the pylon sign which incorporates the colour red. The proposed sign has a height of 18ft. and the proposed sign face (per side) is 88sq. ft . i.e. 8ft. x lift . The colours used in the sign are red, yellow and white. The above property is loca,tod in a 'G' zono and consists of 0.50 acres with frontati;os o' 11;5 Feet on 'an,; Street and 150 feet on George Street. By-law 76-25 in Section 8(2)(b)(vi) 'Sidi Area' provides " in the case of a ground sign 30 square feet or 0.1;" of the lot area whichever is the cxeater provided that in no case shall amy sign exceed 100 Se..Ft. in area". The proposed sign is 88 square feet, comprised of three (3) areas. Pronto 1�0 Sq. Ft. , price 24 sq. ft. and moosa o 24 sq. ft. Lot area is only 2178 so-. ft. therefore the 30 square feet would apply in this situation. Thin is considerably less than the proposed sign, but seems adeautte in the urban areas, especially if all non-conforminy s3ir, s aro brought into conformity with the By-lair. It is unlikely the proposed sien colours would be mistaken for a traffic signal or cause any confusion with signals erected in the future.
