SUBJECT: Proposed Site Plan Agreement - Geraldine Balint
Part of Lot 31, Concession 5, former Township
of Darlington -- Our File: S-P-1-15
RECOMMENDATIONS:
It is respectfully recommended that the Planning and Develop-
ment Committee recommend to Council the following:
1. That Report P-141-81 be received; and
2. That the attached Site Plan Agreement be executed; and
3. That the Clerk be directed to prepare a By-law for the
purpose of authorizing the execution of the attached
Site Plan Agreement for submission to and consideration
by Council at its meeting of September 21, 1981.
BACKGROUND:
The subject application for Site Plan approval was received by
staff on June 18, 1981. The applicant, Geraldine Balint, is proposing
an expansion to her existing commercial establishment located on the
north-west corner of Regional Road 4 and 34 in the Hamlet of Mitchells
Corners. The site consists of approximately 0.34 hectares (.83 acres)

and presently contains a commercial building housing three stores
and a separate residential dwelling unit. The particular site is
also the subject of a staff report in respect of an earlier and in-
directly related application for rezoning, which is also on the Agenda
at this time.
COMMENT:
In accordance with the Department's procedures, the application
was circulated to members of the Town's Site Plan Committee and various
other affected agencies for comments. As a result of our circulation,
two concerns were identified; one in respect of the number of parking
spaces provided and the other in respect of the need to locate in Mitchells
Corners a reservoir for fire fighting purposes. By-law 2111, as amended,
would require a total of twenty-four (24) spaces for this proposal, one
for the residence and twenty-three for the commercial component. The later
figure is based upon one space for each one hundred (100 sq. ft.) square
feet of floor area or portion thereof. Staff have reviewed the By-law
requirement and the applicant's ability to satisfy this requirement on-site
and note that the maximum number of spaces possible without creating a new
access on to Regional Road 34 would be nineteen (19) spaces. A review of
other By-laws within the Municipality indicates a wide variation of parking
requirements for the same uses. These range from 1 space per hundred square
feet in Darlington to 1 space per three hundred square feet in Bowmanville.
Clarke and Newcastle Village fall in between with 1 space per two hundred
square feet. The subject application proposes parking at a ratio of 1 space
per one hundred and twenty-five (125) square feet of floor area, which is,
in our opinion, quite adequate for the proposal. In that regard, staff

report P-130-81 suggests a modification to the By-law amendment for
this property, which would permit a reduction to the parking require-
ments by way of a Special Provision. With regard to the concern about
fire protection and the Fire Chief's request that consideration be given
to the installation of a reservoir for fire fighting purposes, staff have
reviewed the request and acknowledge that while the long-term development
of the Hamlet will necessitate such a facility, we are unable to recommend
that it be required or that it is justified as a condition of the approval
of the proposed expansion to this existing commercial building.
The attached draft Agreement and Site Plan have been reviewed with
the applicant and five signed originals have been provided by her for
execution by the Town. It would now be appropriate to forward this Agree-
ment to Council for execution provided that the Committee wishes to recom-
mend approval of the accompanying rezoning application. Staff feel that
these items should be considered concurrently.

By-law Number 81-
being a By-law to amend Restricted Area By-law
2111, as amended, of the former Township of
Darlington.
WHEREAS the Council of the Corporation of the Town of Newcastle
DEEMS it advisable to amend Restricted Area By-law 2111, as amended,
of the former. Township of Darlington.
NOW THEREFORE the Council of the Corporation of the Town of Newcastle
ENACTS as follows:
1 Section 6, Subsection (d) of By-law 2111, as amended, is hereby
further amended by adding thereto the following subsection. 2 as
follows:
"2. C1-2; Lot 31, Concession 5
Notwithstanding any provisions of Section 6(a) (i) to the
contrary, the land designated "Cl-2" on Schedule 'A' hereto
shall be used only for the purpose of convenience retail
stores , a hairdressing salon, and a single family dwelling
with studio space therein, provided that no building or
structure may be erected or used except in accordance with
the "Cl" Zone Provisions as set out in Section 12 hereto;
and further provided that motor vehicle parking facilities
shall be provided and maintained on the basis of one (1)
space per each 11.5 square metres of floor space or portion
thereof for the retail stores and service shop and one (1)
space for the dwelling unit."
2. Schedule 'A' to By-Liw Number 2111, ,is amended, is Hereby
further amended by changing to "Cl-2" the zone designation
of the lands indicated as "ZONE CHANGE TO C1-2" on the
attached Schedule "X" hereto.
3. This By-law shall become effective on the date hereof, subject
to the provisions of Section 35(10) of the Planning Act.
