That Report P-140-81 be received; and 2. That application for rezoning Z-A-1-16-2 affecting part of Lot 31, Concession 5, former Township of Darlington be approved; and 3. That the attached By-law be forwarded to Council for approval concurrent with the execution of the Site Plan Agreement referred to by staff report P-141-81. i BACKGROUND & COMMENTS: On October 9, 1980, this Committee considered staff report P-167-80 (copy attached)which recommended approval of a by-law to amend Restricted Area By-law 2111, as amended. Said amendment was to include a hairdressing 1 - 2 - salon and a single family dwelling as permitted uses on the property. On October 16, 1980 Council endorsed the recommendation of the Director of Planning to approve the subject by-law amendment conditional upon the dedication of a 3 metre road widening and 0.3 metre reserve along the Taunton Road frontage of the site. On , the Region of Durham Works Department advised the Town that the required road widening and reserve had been t dedicated. Pursuant to Council's actions of October 16, 1980, it would now be appropriate to forward the subject amendment to Council for approval. However, during the course of our review of a separate application for site plan approval, it was determined that the proposed expansion could not meet the requirements of By-law 2111, as amended, in respect of parking. The present layout of the buildings would necessitate a second separate access into Regional Road 34 in order to facilitate provision of additional parking up to the By-law requirements. The site plan, subject of report P-141-81, proposed parking at a ratio of one space per 125 square feet as opposed to the one space per 100 square feet required, this representing a deficiency of six spaces. In view of the fact that the parking requirements in the former Township of Darlington exceed those of other areas of the Town, relative to commercial uses; and in view of the fact that a second and separate access to the Regional Road 34 is undesirable and contrary to the intent of the Durham Regional Official Plan, staff are suggesting that the subject by-law amendment be further modified to permit a site specific reduction in the parking requirements for this site. i - 3 - The attached by-law has been modified accordingly and if the Committee is agreeable, it should be forwarded to Council for approval concurrent with their consideration of the site plan in respect of this property. July 24, 1981 T' f Director of Planning I THE CORPORATION OF THE TOWN OF NEWCASTLE By-law Number 81- being a By-law to amend Restricted Area By-law 2111, as amended, of the former Township of Darlington. WHEREAS the Council of the Corporation of the Town of Newcastle DEEMS it advisable to amend Restricted Area By-law 2111, as amended, of the former Township of Darlington. NOW THEREFORE the Council of the Corporation of the Town of Newcastle ENACTS as follows: 1 Section 6, Subsection (d) of By-law 2111, as amended, is hereby further amended by adding thereto the following subsection 2 as follows: "2. Cl-2; Lot 31, Concession 5 Notwithstanding any provisions of Section 6(a) (i) to the contrary, the land designated "Cl-2" on Schedule 'A' hereto shall be used only for the purpose of convenience retail stores, a hairdressing salon, and a single family dwelling Cwith studio space therein, provided that no building or I structure may be erected or used except in accordance with the "Cl" Zone Provisions as set out in Section 12 hereto; I and further provided that motor vehicle parking facilities shall be provided rind maintained on the basis of one (1) I space per each 11.5 square metres of floor space or portion 3 thereof for the retail stores :tud service sliop and oue (1) i space for the dwelling unit. Schedule 'A' to By-law Number 2111, as amended, is hereby further amended by changing to "Cl-2" the zone designation of the lands indicated as "ZONE CHANGE TO C1-2" on the attached Schedule "X" hereto. 3. This By-law shall become effective on the date hereof, subject to the provisions of Section 35(10) of the Planning Act. BY-LAW READ a first time this day of day A.D. 1981.
