SUBJECT: Request by Suncor (Sunoco Group) for an exemption
from the provisions of the Sign By-law - Sunoco
Service Station, 96 King Street East, Bowmanville
File: 8.1.9
RECOMMENDATIONS:
It is respectfully recommended that:
1. This Report be received for information; and
2. The Planning and Development Committee recommend to
Council approval of an exemption from Section 4(3) (b)
of the Sign By-law as requested by Sunoco Inc.
BACKGROUND:
A request has been made to Council for an exemption from the
provisions of the Sign By-law of the Town of Newcastle (.copy attached)
to permit the erection of a pylon sign in front of the existing Sunoco
Service Station located at the corner of King and George Streets in
Bowmanville. This request has been referred to the Planning and
Development Committee for a recommendation.

The proposed identification sign is permitted in the
"Commercial" zone in Bowmanville. However, the proposed sign is
to include the colours of red and amber, which are not permitted
by the By-law. Section 4(3)(b) of the Sign By-law states that "no
illuminated sign which uses the colours red, green or amber shall be
located within 150 feet of a traffic control signal nor within 150

feet of an intersection of two or more streets, except by Special
Resolution of Council. This provision shall not apply to signs located
more than 25 feet from any street line."
COMMENTS:
Staff have reviewed the request by Suncor and would have
no objection to exempting this particular sign from Section 4(3) (b) of
the Sign By-law subject to compliance with all other provisions of the
sign by-law (sign area) .
In addition, staff have reviewed correspondence from the Chief
Building Official which indicates that the proposed colours of the sign
would be unlikely to be mistaken for a traffic signal, or, cause any
confusion with traffic signals, if installed at this corner in the future.
Therefore, a resolution of Council would appear to be appropriate in this
particular instance.

Please find attached two prints of Site Plan Drawing No. 67-37P,
Revision 1, and two prints of Pylon Sign Drawing No. PS-2, Revision 1,
along with an 8" x 10" photograph showing the pylon sign which we wish
to erect on the subject property.
Apparently the erection of this sign will be in violation of
Section 4, Sub-section 3(b) of Bylaw No. 76-25. This bylaw, in effect,
restricts signs using the colours red, green, or amber within 1SOft. of
a traffic control signal or within 1SOft. of an intersection of two or
more streets, except by special resolution of Council.
The location of this pylon sign has been considered at great length
by our Retail Design people. The location of the sign at the west side
of the property will render it ineffective as there will be no visibility
for eastbound traffic. Another consideration was to locate it between
the two entrances (in the area of the existing pump islands) . However,
there is insufficient space to allow the sign location here. The most
practical location for our sign would be as shown in the attached Site
Plan Drawing.

I would, therefore, request that the Town give consideration to an
exemption from Section 4, Sub-section 3(b) of the Sign Bylaw, and permit
the use of the pylon sign which incorporates the colour red.
The proposed sign has a height of 18ft. and the proposed sign face
(per side) is 88sq.ft. i.e. 8ft. x lift. The colours used in the sign
are red, yellow and white. The existing ground sign will be removed when
replaced with the subject pylon sign.

The above property is locatod in a 'C' ryone and
consists of 0.50 acres with frontages of 145 beet on zfin(

By-law 76-25 in Section 8(2)(b)(vi) Axe,),,

The proposed sign is 88 oquare .feet, coruncised of

message 24 sq. ft. Lot area is only 2178 so. ft. therefore
the 30 square feet would apply in this situation. This is
considerably less than the proposed Sit, but a,decua to
