REPORT NO. : P-125-81 SUBJECT: Rezoning Application Z-A-2-6-3 - Part of Lot 10, Concession 2, Bowmanville -- Mr. A. Brooking RECOMMENDATIONS: It is respectfully recommended that: 1. This Report be received; and 2. Rezoning Application File Z-A-2-6-3 be closed. I BACKGROUND: On November 29, 1979, Town Council adopted the following re- commendation in respect of rezoning application Z-A-2-6-3: "l. That the amending By-law be forwarded to Council for first and second readings (By-law 79-13) ; I 2. That staff be authorized to negotiate the Development Agreement as described in Section 35(a) of the Planning Act with the applicant; and i 3. That the said Development Agreement be signed by the applicant and the Town of Newcastle prior to the third reading of the By-law. " Planning and Development staff have requested the applicant and the applicant's solicitor to commence negotiations of the Develop- ment Agreement on a number of occasions since Council's adoption of I - 2 - the above-noted recommendations. On June 19, 1981, staff received the attached correspondence in respect of the rezoning application. It would now be appropriate for the rezoning application file to be closed. Staff feel that if this matter is to be re-opened at any time, that it would be appropriate for a new rezoning application to be sub- mitted to the Town. C Respectfully submitted, DNS:lb D. N.
