REPORT TO THE PLANNING AND DEVELOPMENT COMMITTEE MEETING OF JULY 6, 1981.
REPORT NO. : P-124-81
SUBJECT: Objection to By-law 81-52 -- Part of Lot 25,
Concession 3, former Township of Darlington
(G. Gerrits)
RECOMMENDATION:
It is respectfully recommended that:
1. This report be received; and
2. The Planning and Development Committee recommend to
Council that the following resolution be adopted and
forwarded to the Ontario Municipal Board:
"WHEREAS the Town of Newcastle has considered all of the
objections to Restricted Area By-law 81-52; and
WHEREAS the Town of Newcastle is satisfied that the
proposed By-law is in conformity with the Durham Regional
Official Plan in that the Official Plan allows a Municipality
to recognize an existing use; and
WHEREAS the Ministry of Agriculture and Food have no objections
to the proposal;
BE IT NOW RESOLVED that the Town of Newcastle hereby requests
the Ontario Municipal Board to approve By-law 81-52, and

hereby authorizes Planning staff and the Town Solicitor
to attend any hearing that may be convened in respect
of the By-law on behalf of the Town."
BACKGROUND:
Town Council approved By-law 81-52 on May 4, 1981 rezoning a
5.7 hectare (14.0 acre) parcel of land located in Lot 25, Concession
3, Darlington to recognize the existing uses of the property.
As a result of the circulation of the By-law, one objection
was received (copy attached) . The objector is apparently concerned
that the rezoning of the property to recognize existing uses represents
a loss of agricultural land and would be more suitably located in an
industrial area.
Staff note that the Ministry of Agriculture has not objected to
the proposal on the basis that the property is not in agricultural use
and that there is a lack of agricultural activity in the surrounding area.
Staff note that the subject land is approximately 14 acres in area
and as such may not be considered a viable agricultural parcel. Staff feel
that the rezoning, while allowing for some expansion of the existing uses, does
not represent a serious intrusion into the area, nor represents a significant
loss of agricultural land. Staff recommend that the By-law be forwarded to
the Ontario Municipal Board for approval with the resolution contained within
the recommendation.

am writing to you in reqPrds to By-Law 01-52.
am a land owner, owing part of lot 25 con 1 3 and part
of lot #24 Con 3 Darlington , bein� 2aiwc, tilt are
adjacent to the Gerritts prpperty , and I feel that
must strongly object to by-law #81-52 . toy:
I feel this land must remain aqriculturnl and that,
there is sufficient lands for businows to operate and
WVP storage buildings in the industrial areqs designated
by the Town of Newcastle .
My experi�!nce has been that these band owners have no
regard for agriculture and are very iny when it comes
to repairing and maintaining fences , and have very little
respect for those in the agriculture husinnss .
For this reason
I I Object to BY-law 181-52 or any
change to by law # 2111 .
