REPORT NO. : P-120-81 SUBJECT: Revisions to draft Approved Plan of Subdivision 18T-75362 - Part of Lot 19, Concession 10, Darlington - Burketon Hills - Our File: S-A-1-15-5 RECOMMENDATIONS• It is respectfully recommended that the Planning and Develop- ment Committee recommend to Council the following: 1. That Report P-120-81 be received; and 2. That the requested revisions to draft plan 18T-75362 be L approved with the exception of those changes affecting lots 19 to 21 inclusive; and 3. That the applicants be requested to submit five (5) copies of the revised plan to staff incorporating the approved revisions; and f 4. That upon receipt of an appropriately revised plan, the Ministry of Housing be advised that the Council of the Town i of Newcastle by staff requests the Minister of Housing to revise draft approved plan of subdivision 18T-75362 to show an additional five (5) single family detached lots and an adjustment to Street 'D' , in accordance with the attached I i - 2 - plan. The Council of the Town of Newcastle further re- quests that all conditions of draft plan approval applicable to 18T-75362 remain applicable to the plan as revised and references to lot numbers amended accordingly. BACKGROUND: On March 17, 1980, staff received a request, from Marshall, Macklin, Monaghan Ltd. acting on behalf of the owners of the subject property, that the Town consider further revisions to their proposed plan of subdivision, which was draft plan approved on January 1, 1980. The revisions requested by the applicant would increase by seven (7) the total number of lots, proposed by the plan. All other aspects of the plan would remain unchanged. In accordance with the Town's procedures for reviewing such revisions, the revised plan was re-circulated to all affected agencies for comments. The results of that circulation are summarized below. Town of Newcastle Works Department The Works Department comments remained unchanged from their original comments on the draft approved plan with the one exception being a request that that section of Old Scugog Road abutting the development be upgraded to Town standards. (Staff note that the Town's conditions of draft plan approval presently include a provision which would require the developer to pay half the cost of reconstructing Old Scugog Road. The more recent request of the Work's Department for total recon- struction cannot be justified by the revisions proposed to the plan and is therefore not warranted.) Town of Newcastle Community Services Dept. Comments remain unchanged. Town of Newcastle Fire Department Comments remain unchanged. 3 - Durham Regional Planning Dept. ". . .we wish to advise that the lot line changes as proposed by the applicant would have the effect of increasing the number of lots from 52 (as draft approved) to 59. You are aware that section 3.1.1 of the Development Plan allocates 51 lots to the area covered by the proposed plan of subdivision. Although the said section refers to the effect that the figures are approximate only, we wish to highlight that Section 3.2.2 (iii) stipulates the number of residential units in the Hamlet Development Plan area shall not exceed 150 units. It is therefore apparent that an increase of 7 lots as proposed by the applicant would have an offsetting effect on the other developable areas within the hamlet. We do not consider that the 7 lot increase contravenes the policies of Development Plan and have no concerns if such is deemed desirable by the Town." Durham Regional Works Dept. Comments remain unchanged. Durham Regional Health Unit "As the "red-line revision" still provides large lots with more than sufficient area for private sewage disposal systems, this department has no objections to the altered proposal. We would appreciate receiving a more definite plan as the revised plan is not too exact." _Central Lake Ontario Conservation Authority "We would refer you to our letters dated Jan. 10, 1979 and Sept. 14, 1979 to the Ministry of Housing and Aug. 1, 1979 pertaining to the subject lands. The changes portrayed on the revised plan do not alleviate our concerns for the site and our comments must therefore remain unchanged." Ministry of Natural Resources Comments remain unchanged. Ontario Hydro "We noted from the plan you submitted to us that several of the lots were influenced by the Ontario Hydro easement which crosses the south end of the proposed subdivision, to the extent that building on them could be severely restricted or eliminated. We will, of course, insist that our easement rights be respected. You may be assured that electric power will be available to the proposed subdivision if and when it is required." Peterborough-Victoria-Northumberland and Newcastle Roman Catholic Separate School Board Comments remain unchanged. - 4 - Northumberland and Newcastle Board of Education "I have been directed to advise that no objection is raised to the subdivision but wish to note that school bus trans- portation would be required to accommodate students at Enniskillen Public School." C. P. Rail No further comments. COMMENTS: Based upon our review of the proposed revisions and the results of the recent circulation, staff are satisfied that the re- visions are compatible with the intent of the Town's previous recom- mendation for approval. The one exception being a proposed adjustment to lot boundaries in the vicinity of lots 19 to 21, inclusive. Staff cannot support the requested revisions and recommend that the adjustment previously requested by staff, which would increase the size of lot 19, be re-affirmed. This would have the effect of reducing the number of additional lots requested to five (5) . CONCLUSION: Based upon the foregoing, we recommend that the requested revis- ions be approved with the exception of the changes to lots 19, 20 and 21 inclusive. Respectfully submitted, I TTE:lb D. N.
