SUBJECT: A Proposed Noise Control By-law for the Town of
Newcastle and Comprehensive Licencing By-laws
Planning and Development Committee Resolution
PD-205-81
RECOMMENDATIONS:
It is respectfully recommended that:
1. This report be received; and
2. The Planning and Development Committee authorize Planning
and Development staff to circulate the draft proposed Noise
Control By-law to interested persons and organizations for
comment; and
3. Staff be requested to prepare a further report in respect
of a possible Noise Control By-law for the Town of Newcastle.
BACKGROUND:
On December 6, 1979, Planning staff submitted the attached report
P-219-79 to Committee for consideration. In accordance with the recommen-
dation within that report, the draft Noise Control By-law was referred to

the Finance and Administration Committee for review with the By-law
Enforcement Officer. The By-law Enforcement Officer was also authorized
to circulate the By-law for comments as he considered appropriate.
On May 25, 1981, the Planning and Development committee adopted
the following resolution PD-205-81:
"THAT WHEREAS staff during the past year prepared a draft
Noise By-law and some work on matters of general licencing;
THEREFORE BE IT RESOLVED the Director of Planning and the
Town Clerk review this work and report back to the Committee."
Further to the Planning and Development Resolution of May 25, 1981,
the Town Clerk and the Director of Planning have met to discuss general
licencing provisions for the Town of Newcastle and will be submitting
a report in respect of this matter in conjunction with a report regarding
places of amusement in Bowmanville. Staff will also be bringing forward
a possible policy in respect of the enforcement of by-laws in conjunction
with this further report.
For the purposes of proceeding with a possible Noise Control By-law,
Planning and Development staff feel it would be appropriate to now proceed
with the circulation of the draft by-law prepared in 1979 and to obtain
comments from interested persons, groups and organizations. As noted in
staff report P-219-79, Planning staff feel that further review of the pro-
posed by-law is warranted. Staff note that the by-law was briefly discussed
with representatives of the Durham Federation of Agriculture at the same time
as discussions were taking place in respect of the proposed Maintenance
and Occupancy By-law. Representatives of the Federation of Agriculture

indicated that they had a number of concerns with the by-law in its
current form and staff would like to have a further opportunity of re-
viewing those concerns with the Federation.
