SUUCT: EXTENSION OF CONTRACT WB5-90, MUSCILLO TRANSPORT LIMITED
COLLECTION AND DISPOSAL OF RECYCLABLES FROM BLUE BOXES
RECOMMENDATIONS:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report TR-4-92 be received;
2 . THAT the attached By-Law be passed, authorizing the
Mayor and the Clerk to sign an agreement with Muscillo
Transport Limited for the extension of contract
WB5-90, for a period of one (1) month at a unit price
of $0 .423 per stop;
3 . THAT Muscillo Transport Limited be advised of Council's
actions; and
4 . THAT the above recommendation be approved FORTHWITH.
BACKGROUND AND COMMENT:
Contract WB5-90 with Muscillo Transport Limited, for the
collection and disposal of recyclables from the blues boxes
expired December 31, 1991. However, service with Muscillo
Transport Limited would currently end one ( 1) week earlier on
December 24, 1991, as the contract does not require blue box
collection over the period from Christmas to New Years.
As the new contract with Miller Waste Systems which was awarded
by Council on October 15, 1991 does not commence until February
1, 1992, an extension to the existing agreement was negotiated by
the five (5) area Municipalities and the Region of Durham. The
Region of Durham, who will be funding all costs associated with
the extension have agreed to the negotiated price of $0 .423 per
stop However, since the existing contract is between the

Municipality and Muscillo Transport Limited, Council approval is
required. A copy of the extension agreement is attached marked
Schedule "B" .
Due to the timing of this extension, a forthwith approval is
requested.
For the information of Council the current price per stop is
$0 .296 .

BY-LAW #92-
Being a By-Law to authorize the execution of an Agreement with
Muscillo Transport Limited for the extension of Contract WB5-90
THE CORPORATION OF THE TOWN OF NEWCASTLE HEREBY ENACTS AS FOLLOWS:
That the Mayor and the Clerk are hereby authorized to execute, on
behalf of the Corporation of the Town of Newcastle, and seal with
the Corporate Seal, an Agreement between Muscillo Transport
Limited and said Corporation, which is attached hereto and marked
Schedule "B".
By-Law read a first and second time this day of January 1992.
By-Law read a third time and finally passed this day of
January 1992.

SCHEDULE "B"
This AGREEMENT made in triplicate the day of
,1991.
BETWEEN:
MUSCILLO TRANSPORT LIMITED
hereinafter "Muscillo"
—AND—
THE CORPORATION OF THE TOWN OF NEWCASTLE
hereinafter "Newcastle"
In consideration of a revised payment scheme, the covenants
exchanged herein, and further consideration, the receipt and
sufficiency . of which are hereby acknowledged, Newcastle and
Muscillo agree as follows:
1. Contract No WB5-90 between the parties for The
Collection and Disposal of Recyclables from the Blue
Boxes, shall be amended to change the termination date
from December 31, 1991, to January 31, 1992, and to
alter the payment to a revised payment of $0.423 per
stop per week.
2. The revised payment shall take effect for all stops
commencing December 23, 1991 and ending January 31,
1992 and shall be based on a six (6) week period.
3. All other terms and conditions of the contract shall
remain in full force and effect.
4. Muscillo agrees to provide proof of the necessary
extension of insurance in the amounts specified in the
contract documents.
IN WITNESS WHEREOF, the Parties have hereunto affixed their
corporate seals, attested to by the hands of their proper
officers in that behalf fully authorized.
