THAT Report EGD-36-02 be received; 2. THAT Part 14, Plan 10R-3804, being lands set out for a road widening on Haines Street be open and dedicated as public highway (Attachment #1); 3. THAT Part 17, Plan 10R-3804, being a one foot reserve on Haines Street be lifted and Part 17, Plan 10R-3804 be open and dedicated as public highway (Attachment #1); 4. THAT Staff be authorized to advertise a public hearing, as required by the Municipal Act, to open, dedicate and assume Parts 14 and 17, Plan 10R-3804 as publiC highway; 5. THAT, provided no objections are registered; Council pass the appropriate proposed by- laws to open, dedicate and assume Parts 14 and 17, Plan 10R-3804; 6. THAT, if following the public hearing, Council approves the by-law to open, dedicate and assume Parts 14 and 17, Plan 10R-3804 as public highway, the Mayor and Clerk be authorized to execute the necessary documents to complete the transaction; and 7. Director of Engineering Services Reviewed bO~~ Franklin Wu Chief Administrative Officer ASC/JCO/wc June 19, 2002 REPORT NO.: EGD-36-02 PAGE 2 1.0 BACKGROUND Council approved the sale to Ontario Independent Crematoriums Ltd. of Part 1, Plan 40R-19752, at its meeting May 29,2001. The land was transferred to the Company by Transfer dated July 13, 2001 and registered as Instrument No. DR13359 on August 13, 2001. There are two strips of land owned by the Municipality which intervene between the transferred lands and Haines Street. Therfore, the transferred lands do not have frontage to an open maintained road as required by the Zoning By-law. 2.0 COMMENTS The transferred land is adjacent to the Bowmanville Cemetery and intended to be the site of a crematorium and associated facilities. The easterly limit of the land transferred to the Company was intended to be the westerly limit of Haines Street which would have provided the Company with frontage on a public street. However, a strip of land 3.05 metres (10 ft.) wide reserved by the Municipality of Clarington for road widening and a one foot reserve intervenes between the westerly limit of Haines Street and the easterly limit of Part 1 on Plan 40R-19752. The intervening parcels are shown as Parts 14 and 17 on Plan 10R-3804. 3.0 CONCLUSION In order to satisfy the requirements of the Zoning By-law to obtain the necessary approvals to proceed with construction of the Crematorium, the site must have frontage to an open, maintained road.
