It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. That report TR-79-92 be received for information and
endorsed;
BACKGROUND & COMMENTS
In accordance with Resolution #GPA-537-92, the Administrator and
the Treasurer awarded the following Tenders/Contracts during the
August Council Break:
1. Tender NW92-29, Painting at Newcastle Village Arena
2 . Co-Operative Tender D92-8, Hot Mix Paving, Various
Locations
A summary outlining the bids and awards is attached (Schedule
"B" ) .

Tender NW92-29 was publicly advertised and issued with the following

Funding for the painting at the Newcastle Village Arena will be drawn
from account #7029-X-0501, as reflected on page #179 of the approved
1992 Capital Budget.
The subject firm has not previously performed for the Town of
Newcastle, but has performed satisfactorily for the Town of
Orangeville and the A.G. Simpson Company..
Subsequently, the contract was awarded to Induspray Contract Painters
Inc. , Toronto, Ontario, in amount of $21,646 . 10.

2 . Co-Operative Tender D92-8, Hot Mix Paving, Various Locations
Since 1989, the Public Works Department have participated in a co-
operative tendering arrangement with the Region of Durham, for Hot Mix
Paving and Granular Shouldering.

Although, the contract conditions include both the Region of Durham's
requirements and the Town of Newcastle's requirements, they are not
independent of each other but rather are considered as one ( 1)
complete contract. However, the contract award is subject to the
approval of the Region of Durham, the Town of Newcastle and the
Ministry of Transportation. In this instance, the Town of Newcastle
actually issues the purchase order to the Region, not the contactor.
Inadvertently, the Region of Durham awarded contract D92-8 to Bennett
Paving & Materials Ltd. , without Town of Newcastle's approval, and in
fact the work had commenced. To request that all further work be
stopped until such time as Council approval was received, would have
posed a safety hazard to all persons travelling on these roads .
The Town of Newcastle portion of contract D92-8 is at a total
estimated cost of $333,990. 83. The attached letter from the Region of
Durham marked Schedule "A" outlines the total bid amounts of all of
the bids submitted, as well as the total estimated cost of the Town of
Newcastle portion.
Total expenditures included in the 1992 Public Works Capital Budget
are as follows:

Regional staff recommended the award of Parts A & B of this Contract to Bennett Paving &
Materials Ltd., and Part C to D. Crupi & Sons Ltd. Regional Council approved this
'recommendation on June 10, 1992.
Based on the tender of Bennett Paving & Materials Ltd., the Town of Newcastle share of this
contract has been estimated as follows:

Recommendation
A. THAT the low tender of Bennett Paving and Materials Limited in
the amount of $1,850,940.53 including G.S.T. , be accepted for
Contract No. D92-8A/B for hot mix paving and granular
shouldering at various locations throughout the Region of
Durham.
B. THAT the low tender- of D. Crupi & Sons Limited in the amount of
$802,273 . 16 be accepted for Contract D92-8C for hot mix paving
and granular shouldering on Regional Road #4 from Regional Road
#30 to 1.5 km east of West Duffin Creek (Taunton/Steeles
project) .
C. AND THAT the Chair and Clerk be authorized to sign the contracts
for this work.

Tenders were received on May 21, 1992, for Durham Region Contract No.

Work under this contract was divided into part "A" (Durham Region -
various .locations throughout the Region, Part "B" (Town.-of Newcastle -
various locations) and part "C" (Durham Region - Taunton Rd. -
Pickering) . The contract was separated into two portions for bidding
purposes being Contract D92-8 A/B and Contract' D92-8C. The
contractors were given the following bid options:

3 Contract D92-8 A/B & D92-8 C (combined)
All contractors were required to bid option 3 and were permitted to
bid Options 1 and/or 2 . The contract was set up in this manner to
obtain the most beneficial prices possible.
The tenders have been analyzed and it is recommended that the low
tenderer Bennett Paving and Materials Limited be awarded Contract
D92-8 A/B and that the low tenderer D. Crupi & Sons Limited be
awarded Contract D92-8 C.
The estimated cost of Contract No. D92-8 is as follows:

Contract D92-8 provides for the application of hot mix paving
granular shouldering,' . pavement pulverizing, granular base
placement, the application of surface course asphalt on Regional
roads constructed under the 1991 Road Program, and miscellaneous
paving at various locations throughout the Region.

will be paid for by the Town of Newcastle
TOTAL AVAILABLE FINANCING $3,131,300
The total available financing of$3, 131,300 compares to the total
estimated cost based on the low tenders of $2,961,000. Sufficient
funding is available to allow Contract D92--8 to' proceed.
Design and supervision of all work included under Contract No.
D92-8 is being done byy Regional staff. Work under this contract 'is
expected to commence by mid June and should be completed by mid
October 1992 .
