MONITORING OF THE DECISIONS OF THE COMMITTEE OF
ADJUSTMENT FOR THE MEETING OF NOVEMBER 29, 2001 AND
DECEMBER 13, 2001
Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report PSD-001-02 be received; and
2. THAT Council concur with decisions of the Committee of Adjustment made on
November 29, 2001 and December 13, 2001 for applications A2001/056,
A2001/062, to A2001/065, inclusive and A2001/067 and that Staff be authorized
to appear before the Ontario Municipal Board to defend the decisions of the
Committee of Adjustment.

1.0 APPLICATION DETAILS
1.1 All applications received by the Municipality for minor variance are scheduled for a
hearing within 30 days of being received by the Secretary-Treasurer. The purpose
of the minor variance applications and the Committee's decisions are detailed in
Attachment 1. The decisions of the Committee are detailed below.

DECISIONS OF COMMITTEE OF ADJUSTMENT FOR
NOVEMBER 15, 2001 & DECEMBER 13, 2001
2.0 The Committee of Adjustment originally considered application A2001/056 on
November 1, 2001. During a site inspection by Staff, it was noted that the sketch
submitted by the applicant did not identify all eleven (11) accessory buildings and
structures on the property. The applicant agreed to amend his application to
include the accessory buildings, which required an increase in lot coverage by
accessory buildings from the permitted maximum of 40% to 104%.
The portion of the application for an addition to the dwelling and a detached
garage received approval and the amended portion for the existing accessory
buildings was re-circulated, a new sign erected and new public notice given for a
Committee of Adjustment meeting held on November 15, 2001. The application
was tabled to the November 29, 2001 meeting, as the applicant was unable to
attend.

The Committee of Adjustment did not consider the amended portion of the
application, for an increase in lot coverage by accessory buildings to 104%, to be
minor in nature, or desirable for the neighbourhood. Thus the amended portion of
the application was denied. The applicant was allowed to retain all the accessory
buildings until July 31, 2002 providing the applicant winter protection and time to
build the addition and attached garage on his dwelling. After July 31, 2002, all
accessory buildings exceeding 40% of the floor area of the dwelling existing on
July 31, 2002 must be removed from the subject property.
3.0 Staff has reviewed the Committee's decisions and is satisfied that the applications
that received approval are in conformity with the Official Plan policies, consistent
with the intent of the Zoning By-law and are minor in nature and desirable.
Council's concurrence with the Committee of Adjustment decisions is required in
order to afford Staff's official status before the Ontario Municipal Board in the
event of an appeal of any decision of the Committee of Adjustment.
