Subject: TENDER NW93-61 OILS AND LUBRICANTS
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT the Addendum to Report TR-22-93 be received; and
2 . THAT the amendment to By-law #93-42 attached to the Addendum to
Report TR-22-93 be forwarded to Council for approval.
BACKGROUND AND COMMENT:
On March 22, 1993, Council adopted the recommendations contained in
Report TR-22-93 and approved By-law #93-42, a by-law to authorize the
issuance of a purchase order to R.P. Oil Limited in respect to the
supply of Oils and Lubricants Products for the Town of Newcastle.
Paragraph 2 of By-law #93-42 (Attachment #1 to the Addendum to Report
TR-22-93) reads as follows:
"THAT this By-law not take effect until approved by the Ontario
Municipal Board, pursuant to Section 65 ( 1) of the Ontario
Municipal Board Act, Chapter 0.28, R.S.O. 1990. 11
Bill 165, an Act to amend certain Acts related to municipalities, has
amended the Municipal Act and the Ontario Municipal Board Act by
stating that approval by the Ontario Municipal Board of miscellaneous
undertakings by the Municipalities is no longer required as long as the
municipality does not exceed the limit prescribed under Clause 4(b) of
Section 147 of the Municipal Act. The Ontario Municipal Board have
also confirmed that their approval is not required.

It is therefore recommended that the amending By-law, which deletes
Paragraph 2 from By-law #93-42, be forwarded to Council for approval.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 93- 42
Being a By-Law to authorize the issuance of a purchase order to
R.P. Oil Limited
in respect to the Supply of Oils and Lubricants Products
for the Town of Newcastle
WHEREAS on March 22, 1993 the Council of the Town of Newcastle approved
Report TR-2-93, authorizing the issuance of a purchase order to R.P. Oil
Limited for the supply of oils and lubricant products.
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCAS*LE
HEREBY ENACTS AS FOLLOWS:
1. THAT the Purchasing and Supply Agent be authorized to issue
a purchase order to R.P. Oil Limited for the supply of oils
and lubricant products, in the form attached hereto as
Schedule "B" .
2 . THAT this By-Law not take effect until approved by the Ontario
Municipal Board, pursuant to Section 65( 1) of the Ontario
Municipal Board Act, Chapter 0.28, R.S.O. 1990.
By-Law read a first and second time this 22 day of March, 1993.
By-Law read a third time and finally passed this 22 day of March, 1993.

THE CORPORATION OF THE TOWN OF NEWCASTLE
BY-LAW NUMBER 93-
Being a By-law to amend By-law #93-42, being a
By-law to authorize the issuance of a purchase
order to R.P. Oil Limited in respect to the
Supply of Oils and Lubricants Products for the
Town of Newcastle.
WHEREAS it is deemed expedient to amend By-law #93-42;
NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE TOWN OF NEWCASTLE
HEREBY ENACTS AS FOLLOWS:
1. THAT Paragraph 2 be deleted in its entirety.
By-law read a first and second time this 14th day of June, 1993.
By-law read a third time and finally passed this 14th day of June,
1993.
