THAT Report TR-73-93 be received; 2 . THAT Snyder Construction, Whitby, Ontario, with a total bid in the amount of $62,288.71, being the lowest responsible bidder meeting all terms, conditions and specifications of Tender NW93-27, be awarded the contract for Elliot Memorial Park, as required by the Department of Community Services; 3. THAT the attached By-Law, marked Schedule "A" , be forwarded to Council for approval; and 4 . THAT the total required funds in an approximate amount of $69,788.71 (62,288 . 71 contract + $7,500. 00 consulting, design, contract administration and expenses) , be drawn from the Community Services Lot Levy Account #1110-156-X as carried over from 1992 . BACKGROUND AND COMMENT: Tender specifications were provided by Henry Kortekaas & Associates Inc. for the construction of Elliot Memorial Park as required by the Department of Community Services. Subsequently, bids were received and tabulated as per schedule "B" attached. As the total bid price of $71,420.31 plus an approximate amount of $7,500 .00 for consulting design and contract administration exceeds the $72,000. 00 carried over from 1992, deletions to the contract reducing the contract value to $62,288 . 71 are proposed as outlined in the attached letter from the consultant Henry Kortekaas & Associates Inc . , marked Schedule "C" . A comparison of each of the bids submitted, was done with the deletions, and is also indicated in the letter from Mr. Kortekaas . 11 1R 11-1 K YlIA- Page Two TR-73-93 Tender NW93-27 - Elliot Memorial Park Therefore, the total required funds in the approximate amount of $67,788 . 71 $62,288.71 reduced contract value + $7,500 . 00 consulting, design, contract administration and expenses) , will be drawn from the Community Services Lot Levy Account #1110-156-X and are within the $72,000 .00 budget allocation, as carried over from 1992 . The Treasurer has reviewed the funding requirements and concurs with the recommendation. Queries with respect to department needs, specifications, etc. , should be referred to the Director of Community Services. Although the subject firm have not previously performed for the Municipality of Clarington they have provided satisfactory service to Bell Canada and the Durham Board of Education. THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the Corporation of the Municipality of Clarington with the Corporation Seal, a contract between Snyder Construction and said Corporation. 2 . THAT this agreement attached hereto as Schedule "A" form part of this By-law. By-law read a first and second time this day of September, 1993 . Williams Construction, Rutherford Contracting, and Partak Limited. I have prepared a comparison spreadsheet and found that the lowest tenderer, Snyder Construction is in order. I have also called references relating to Snyder Construction and I have been advised that he is a contractor having high standards and a high quality of work. Snyder Construction, however, has no experience in playground construction nor is he a member of Landscape Ontario. Nevertheless, he feels he can do the work and since he has built several buildings it appears he can. Furthermore, he is working with Bryden Landscaping, who is a recommended Landscape Contractor. Nevertheless, the contract is above the budget and I would recommend the following to bring the contract in line with the budget. • Delete 2 benches (item 6) for a saving of $ 720.00 • Delete 1 trash receptacle (item 7) for a saving of $ 450.00 • Delete the requirement for snow fencing around the existing trees for a saving of $ 2,220.00 • Sub-total $57,653.00 • G.S.T. $ 4,035.00 • Total amount to the contractor $61,688.71 • Contingency $ 600.00 instead of the 10% contingency -Q j Total Project !:_ $62,288.71 LANDSCAPE ARCHITECTURE ENVIRONMENTAL PLANNING&RECREATIONAL PLANNING Due to, the contractor's qualifications and knowledge, and straight foreword nature of this project, I feel that the Contingency may not be required in this case.
