J- By-Law# Report#: TR-8 3-9 3- File #: Subject: TENDER NW93-33, ROTARY PARK - PHASE II Recommendations: It is respectfully recommended that the General Purpose and Administration Committee recommend to Council the following: 1. THAT Report TR-83-93 be received; 2 . THAT Rutherford Contracting Ltd. , Gormley, Ontario, with a total bid in the amount of $142,511.00, being the lowest responsible bidder meeting all terms, . conditions and specifications of Tender NW93-33, be awarded the contract for Rotary Park - Phase II, as required by the Department of Community Services; 3 . THAT the attached By-law, marked Schedule "All be forwarded to Council for approval; 4 . THAT $22,072 . 67 of the total required funds of $151,061.00 ($142,511.00 contract + $8,550 .00 consulting design and contract administration) be drawn from the Community Services Lot Levy Account #1110-156-X as carried over from 1992; and 5. THAT the remaining required funds in the amount of $128,988.33 be drawn from the approved 1993 Community Services Capital Budget Account #7603-00001-0516 . PIE1 "P'B EIA iHI51S PENYED NI BE GY-13 PAPE n PAGE TWO REPORT TR-83-93 TENDER NW93-33, ROTARY PARK - PHASE II BACKGROUND AND COMMENT: As identified on page 214, in the 1993 Approved Capital Budget, the park development for the Bowmanville Memorial Arena Site totals $210,000 .00 and includes the following allocations: Bandshell/Lookout Deck $ 70,000.00 Treetop Walkway $ 40,000. 00 Bridge $100,000. 00 In accordance with Council Resolution #GPA-460-93, Tender NW93-23, Phase I for the bridge only was awarded to Ron Robinson Limited for a total bid amount of $72,261.67 . The total funds expended for Phase I were $81,011.67 ($72,261.67 contract + $8,750 .00 consulting design, and contract administration) , which is well within the $100,000 .00 allocation for this part of the project. Subsequently, tender specifications were provided by Cosburn Giberson Landscape Architects for Phase II of the project which includes the Lookout Deck and walkway. Greco & Sons Limited $204,501.45* Rexdale, Ontario i *GST Adjusted - Bid Amended I j 702 PAGE THREE REPORT TR-83-93 TENDER NW93-33, ROTARY PARK - PHASE II j The tender submission of the low bidder provided for an alternative with respect to the staircase, which is to use steel piles to support the staircase rather than using steel reinforced concrete inside caissons. This alternative is acceptable to staff and the architect and results in a reduction of the contract by an amount of $12,305.00 . The total required funds for Phase II of this project are therefore $151,061. 00 ($154,816 .00 total bid less $12,304 .00 alternate staircase reinforcement + $8,550.00 consulting, design and contract administration) . This portion of the project is significantly over the estimated budget due to severe soil stability problems identified following recent soil tests which may have resulted in an inaccurate estimate provided by the consultant. The 1992 Capital Budget provided for the prepartion of site plans for the development of the park. In these funds there were allocations for walkways, etc. which relate to Phase II of the project. It is recommended therefore that funds in the amount of $22,072 . 67 be drawn from the Community Services Lot Levy Account #1110-156-X as carried over from 1992 and detailed on page 206 of the 1992 Capital Budget. The remaining funds required in an amount of $128,988. 33 are recommended to be drawn from the total unexpended funds approved for this project in the 1993 Community Services Capital Budget Account #7603-00001-0516, ($210,000. 00 less $81,011.67 Phase I) . The 1992 allocation for this project was $90,000 .00 in total; of which approximately $15,927 .00 has been expended on design and consulting for Phase I and II; $22,073.00 is recommended for Phase II above and the remainder of the 1992 funds in the amount of approximately $52,000. 00 available for use in the future phases of Rotary Park. The Treasurer has reviewed the funding requirements and concurs with the recommendation. Queries with respect to department needs, specifications, etc. , should be referred to the Director of Community Services. After further review and analysis of the bids by Purchasing, Cosburn Giberson Landscape Architects and Community Services, it was mutually agreed that the low bidder, Rutherford Contracting Ltd. , Gormley, Ontario, be recommended for the contract for Rotary Park - Phase II . i The subject firm previously performed satisfactorily for the Municipality of Clarington. THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the Corporation of the Municipality of Clarington with the. Corporation Seal, a contract between Rutherford Contracting Ltd. and said Corporation. 2 . THAT this agreement attached hereto as Schedule "A" form part of this By-law.
