DRIVE AND ASSOCIATED EROSION PROTECTION WORKS,
BOWMANVILLE
Recommendations:
It is respectfully recommended to Council the following:
1. THAT Report EGD-25-02 be received;
2. THAT Staff be authorized to proceed with obtaining all necessary approvals required to
realign the access road from Roenigk Drive to the Bowmanville Creek valley parking lot
and the associated erosion protection work required to stabilize the west bank of the
Bowmanville Creek;
3. THAT the total estimated cost of$102,000.00 be approved and the funds be obtained
from Engineering Account No. 7205-02009-0261;
4. THAT the requirements of Purchasing By-Law No. 94-129 be waived for the purpose of
Phase 1 of this project;
5. THAT Ron Robinson Limited, Bowmanville, Ontario, be awarded part of Phase 1 work at
a cost of$24,917.00 (exclusive of G.S.T.), and that payment for the work be made as
extra work to Contract CL2002-3 (an existing contract between the Municipality and Ron
Robinson Ltd.); and
6. THAT the remaining work be completed by Municipal forces where possible or be
tendered in accordance with the Municipality's Purchasing By-Law.

1.0 BACKGROUND AND COMMENT
1.1 Closure of the Access Road to the Bowmanville Creek Valley
On Thursday April 4, 2002, Engineering Services closed the park access from Roenigk
Drive to the Bowmanville Creek valley to public use as a result of a slope failure adjacent
to the roadway. There was concern that anticipated spring rainfall would continue to
raise water levels in the Bowmanville Creek causing further erosion at the toe of the
embankment while saturating the exposed slope surface leading to a further failure
which could endanger the public.
1.2 Subsequent to the road closure, the Engineering Services Department has initiated the
following actions:
• Contacted the Central Lake Ontario Conservation Authority for input on erosion
protection measures, permit requirements and timing restrictions;
• Commissioned a geotechnical investigation of the failure area to determine the
potential for further movement and suggest methods of stabilization and
restoration;
• Co-ordinated a survey of the area with ongoing work at the King Street/Roenigk
Drive intersection so that a comprehensive base plan of the area was available
for design of remedial measures;
• Reviewed long and short term park and trail needs to ensure remedial works
were designed and constructed within the appropriate context;
• Completed a design for Phase 1 of the required works - a realigned access
roadway that allows for a stable slope between the access road and the
Bowmanville Creek and provides a platform at its base for a future trail adjacent
to the creek; and
• Submitted an Application for Construction to the Central Lake Ontario
Conservation Authority for Phase 1 works.

Engineering Services are now in a position to undertake Phase 1 works so that the
access road can be reopened in time for the Bowmanville Lions Club Rubber Duck
Derby to be held on June 15, 2002. In order to complete the work, construction must
commence within the next week.
1.3 At the meeting of the General Purpose and Administration Committee of May 6,2002,
the Director of Engineering Services provided a verbal status report on the plans to
repair the access road from Roenigk Drive to the Bowmanville Creek Valley. As well,
Council was advised that in order to complete the works prior to the Lions Club Rubber
Duck Derby, work must commence within the week. To have a contractor on site, in
short notice, authorization to proceed and exemption from the Purchasing By-Law is
required.
1.4 Phase 1 Works
It is estimated that the total cost of the Phase 1 works will be approximately $54,000
(exclusive of G.S.T.) including detailed design costs, geotechnical slope stability report,
construction costs, application fees and contingencies. Some of the work can and will
be performed by the Operations Department, however, they do not have all of the
resources required to complete the entire project.
1.5 Exemption from the Purchasing By-Law
In this situation, it is desirable to have the necessary works completed to facilitate the
Bowmanville Lions Club Rubber Duck Derby. The Engineering Services Department
has acquired a cost estimate from Ron Robinson Limited. Ron Robinson Limited will be
completing the work on Concession and Elgin Streets under Contract CL2002-3. They
have provided a price to the Engineering Services Department to assist the Operations
Department with the remedial work. Where items are common to the work being
completed under Contract CL2002-3, unit prices have been honoured (Attachment No.
2). On this basis, they have provided a cost estimate of $24,917.00 (excluding G.S.T.)
that could be charged to Contract CL2002-3 and funded, along with other Phase 1
works, from Engineering Account No. 7205-02009-0261. Council may recall that this
project was projected to be well under budget when approved by Council on April 29,
2002.

1.6 In addition to the Phase 1 access realignment works, additional measures are required
to protect the west bank of the Bowmanville Creek from further erosion adjacent to the
access road. These works have been classified as Phase 2 works. The works to be
undertaken on both Phase 1 and 2 are shown on Attachment No. 1.
1.7 Phase 2 Works— Erosion Protection of West Creek Bank
Based on input from, and on-site meetings with, the local conservation authority it was
determined that it was necessary to provide erosion protection of the west bank of the
Bowmanville Creek within limits shown on Attachment No. 1.
1.8 Approval from the Department of Fisheries and Oceans
As the Phase 2 work will require in-water works and alteration of the Bowmanville
Creek, a cold water fishery, approval would have to be obtained from the Federal
Department of Fisheries and Oceans (DFO). In order to obtain approval from DFO the
proposed remediation plan will have to show that there is a net benefit to fish habitat as
a result of the work. In order to achieve this net benefit, the following will have to be
undertaken:
• Provide erosion protection on the west bank consisting of a 'live crib wall' which
is a naturalized erosion protection constructed of cedar logs and waterside
plantings such as willows that will eventually root in the existing bank and provide
a natural and stable bank and shade cover for fish;
• Realign the creek to reduce the water action that contributed to the bank erosion
while not creating any negative impacts downstream of the realignment;
• Provide 2 — 0.5 m "deep" pools for increased fish habitat within the limits of creek
work; and
• Backfill 'live crib wall' and construct 6 m wide platform for future Bowmanville
Creek Valley trail system within the limits of the erosion protection work.

2.0 CONCLUSION
2.1 As there is a restriction on timing for in-water works related to fish migrating seasons,
the Phase 2 works must be completed between July 15 and September 15 as mandated
by the DFO timing guidelines. It is anticipated that the review and approval process for
the Phase 2 works will take approximately 4 to 6 weeks, therefore, it is critical that the
Municipality proceed with submission of these works as soon as possible in order that
approval be obtained and the necessary tendering process be completed prior to the
July 15, 2002 window.
2.2 It is estimated that the total cost of the erosion protection of the west creek bank and
creek realignment work will be approximately $48,000 (exclusive of G.S.T.), including
detailed design and contract administration.
2.3 In order to construct Phase 2, permission will be required from Ballymore Homes as
some of the creek bank stabilization will encroach on to their property.
