THAT Report TR-91-93 be received; 2 . THAT Resolution #GPA-531-93 awarding contract NW93-31 to Bowman Construction Ltd. , Courtice, Ontario, in an amount of $29, 162 . 85 (including all taxes) be rescinded; 3. THAT Winvalley Contracting, Whitby, Ontario, with a total bid of $35,358. 15 (including all taxes) , being the lowest responsible bidder meeting all terms, conditions and specifications of Tender NW93-31, be awarded the contract for the construction of a salt shed, as required by the Department of Public Works; 4 . THAT the attached By-law, marked Schedule "A" be forwarded to Council for approval; and 5 . THAT the required funds be drawn from the approved 1993 Public Works Department Capital Budget, account #7212- 01001-X. BACKGROUND AND COMMENT: Tender NW93-31 was publicly advertised and invited for the construction of a salt shed at the Orono Depot, as required by the Department of Public Works . Subsequently, as per Council resolution #GPA-531-93, NW93-31 was awarded to Bowman Construction Ltd. (See Schedule "B" attached) . 142 THIS TS EPIRTED-RECYCLED PAPER PAGE TWO REPORT TR-91-93 NW93-31, CONSTRUCTION OF SALT SHED Upon notification of the tender award on September 27, 1993, to the low bidder, it was revealed that the bids remained open for acceptance until September 25, 1993. Although the Council award was not made until September 27, 1993, the subject firm was aware that the contract had been approved by the General Purpose and Administration Committee on September 20, 1993 . i As a result of various problems encountered by the low bidder with the bonding company, cost of permits, as well as additional heating costs with respect to the pouring of concrete, the subject firm have advised that they are not willing to accept the contract award. For the information of Council and as pointed out in report TR- 77-93, Bowman Construction Ltd. , was the successful bidder in 1990 to construct an identical shed for a total bid price which was approximately 20% higher than the bid submitted for Tender NW93-31. The second low bidder, Winvalley Contracting have confirmed in writing that their bid remains open for acceptance and that they are prepared to complete the contract for the total bid price stipulated. As indicated on report TR-77-93, other associated costs are estimated to be $30,000 ..00 and will be completed under separate contracts . i As the total required funds in the amount of $65,358. 15 ($35,358 . 15 contract + $30,000.00 other associated costs) exceeds the $60,000. 00 allocation provided for in the 1993 Public Works Capital Budget, the requirement for paving will be reduced from the other associated costs in order to keep the total expenditure within the approved budget total. The Treasurer has reviewed the funding requirements and concurs with the recommendation. Queries with respect to department needs, specifications, etc. , should be referred to the Director of Public Works . THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the Corporation of the Municipality of Clarington with the Corporation Seal, a contract between Winvalley Contracting and said Corporation. 2. Other associated costs which are estimated to be $30,000. 00 will be completed under separate contracts as follows: Paving (Inside & Apron in front) - Regional Co-Op Tender (Already Awarded) Electrical Wiring - Municipalities ' Electrical Blanket Order Contract (Already Awarded) Painting Interior - Municipal Staff 747 PAPERD REC-1 iH15 6 PR'MED QY RECYCLED PAPER Page Two TR-77-93 NW93-31, CONSTRUCTION OF SALT SHED The total required funds in the amount of $59,162 .85 ($29,162 .85 contract+ $30,000.00 other associated costs) are within the $60,000 .00 allocation provided for in the 1993 Public Works Capital Budget Account #7212-01001-X as reflected on page 70 .0f the 1993 Capital Budget. The Treasurer has reviewed the funding requirements and concurs with the recommendation. Queries with respect to department needs, specifications, etc. , should be referred to the Director of Public Works . For the information of Council the total bid price is. approximately 20% less than the total bid price an identical salt shed was constructed for at the Hampton Public Works . Depot in 1990 . Satisfactory service was provided by the subject contractor at that time. -- After review and analysis of the bids by Purchasing and Public Works, it was mutually agreed that the low bid from Bowman Construction Ltd. , Courtice, Ontario, be recommended for the tender award.
