Subject: TENDER NW93-41 - FOSTER CREEK TRAIL LANDSCAPING
Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1. THAT Report TR-102-93 be received;
2 . THAT J. Kamstra Landscaping Limited, Oshawa, Ontario,, with a total
bid in the amount of $35,000. 00 being the lowest responsible bidder
meeting all terms, conditions and specifications of Tender NW93-41,
be awarded the contract for Foster Creek Trail Landscaping, as
required by the Department of Community Services;
3 . THAT the attached By-law, marked Schedule "A" , be forwarded to
Council for approval; and
4 . THAT the total required funds in an approximate amount of
$39,500. 00 ($35,000 contract + $4,500 . 00 consulting, design,
contract administration and expenses) , be drawn from the Community
Services Capital Budget Account 7603-00001-0516 .
BACKGROUND AND COMMENT:
Tender specifications were provided by Daniel J. O'Brien & Associates
Ltd. for the construction of Foster Creek Trail Landscaping as required
by the Department of Community Services. Subsequently, bids were
received and tabulated as follows:

For the information of Council, the number of bids received is partly as
a result of the timing of the calling of the tender.
However, as time
is of the essence for this contract, staff did not feel that it was in

the best interest of the Municipality to delay the closing in order to
potentially receive additional bids. In addition, other smaller firms
may have been interested, however the condition of bonding posed some
difficulty.
The total required funds in the approximate amount of $39,500.00

($35,000 contract value + $4,500. 00 consulting, design, contract
administration and expenses) , will be drawn from the Community Services
Capital Budget Account 7603-00001-0516 and are within the $42,000.00
budget allocation, as reflected on Page 207 of the 1993 Capital Budget.
A recommendation letter from the consultant is attached marked Schedule
B
The Treasurer has reviewed the funding requirements and concurs with the
recommendation. Queries with respect to department needs,
specifications, etc. , should be referred to the Director of Community
Services.
The subject firm has previously performed satisfactorily for the
Municipality of Clarington.

THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW 93-
Being a By-law to authorize a contract between the
Corporation of the Municipality of Clarington and
Kamstra Landscaping in respect to the Foster Creek
Trail Landscaping.
THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS
FOLLOWS:
1. THAT the Mayor and Clerk are hereby authorized to execute, on
behalf of the Corporation of the Municipality of Clarington
with the Corporation Seal, a contract between J. Kamstra
Landscaping and said Corporation.
2 . THAT this agreement attached hereto as Schedule "A" form part
of this By-law.
By-law read a first and second time this day of December, 1993.
By-law read a third time and finally passed this day of
December, 1993 .

Daniel J, O'Brien Associates Ltd, have reviewed the tender submission by J. Kamstra
Landscaping Limited in the amount of$35,000,00 including all taxes. The appropriate bid deposit
Find agreement to bond are received. The total contract amount of$35,OW,00 is under the estimated
budget amount of $38,000,00 and all areas and unit costing is balanced and fair. J. Kamstra
Landscaping have a previous working relationship with the Municipality of Clarington, in
consideration of all the above we would recommend award of this contract to J. Kamstra
Landscaping Ltd,
