BACKGROUND AND COMMENT
On November 8, 1993, Council awarded Tender NW93-38 to Marigold

Subsequently, a purchase order was issued on November 11, 1993 for
which confirmation from the dealer was received.
On November 29, 1993, staff were advised by Marigold Lincoln
Mercury Sales that they were unable to supply the vehicle ordered
due to a discontinuance by the manufacturer of the specified
engine.
As the bid was submitted and accepted in good faith in accordance
with the general terms and conditions of the tender and was not
subject to the availability of the vehicle, legal action against
Marigold Lincoln Mercury Sales is a possibility. However, the
costs involved in taking such action would likely exceed the
additional costs that would be incurred by accepting the second low
bidder.
It is therefore recommended that the original contract award to
Marigold Lincoln Mercury be cancelled and that the 2nd low bid from
Nurse Chevrolet Oldsmobile be accepted. The total allocated funds
included in the 1993 Community Services Capital Budget account
#7603-00001-0504 are $20,000.00 as reflected on page 202 of the
Capital Budget.
The Treasurer has reviewed the funding requirements and concurs
with the recommendation. Queries with respect to department needs,
i
specifications, etc. , should be referred to the Director of
Community Services .
The subject firm have provided written confirmation that their bid
i
remains open for our acceptance.
