THAT Report TR-104-93 be received; 2 . THAT the contract awarded to Marigold Lincoln Mercury Sales, Whitby, Ontario, for a total bid amount of $18,324 . 10 (including all taxes) , to supply and deliver one ( 1) only 1994 Half-ton Pick Up Truck to the Municipality of Clarington required by the Department of Community Services, be cancelled; 3 . THAT Nurse Chevrolet Oldsmobile Ltd. , Whitby, Ontario, with a total bid of $18,515. 00 (including all taxes) being the next lowest responsible bidder meeting all terms, conditions and specifications of Tender NW93-38, be awarded the contract to supply and deliver one ( 1) only Half Ton Pick Up Truck to the Municipality of Clarington, as required by the Department of Community Services; and 4 . THAT the required funds be drawn from the approved 1993 Community Services Department Capital Budget, account #7603-00001-0504 . BACKGROUND AND COMMENT On November 8, 1993, Council awarded Tender NW93-38 to Marigold Lincoln Mercury Sales, Whitby, Ontario, for the supply and delivery of one ( 1) only 1994 Half Ton Puck Up Truck as required by the Department of Community Services. 4 PAP ELRD EC YCLE REPORT NO. : TR-104-93 PAGE 2 TENDER NW-93-38 ONE ( 1) ONLY 1994 HALF-TON PICK UP TRUCK I Subsequently, a purchase order was issued on November 11, 1993 for which confirmation from the dealer was received. On November 29, 1993, staff were advised by Marigold Lincoln Mercury Sales that they were unable to supply the vehicle ordered due to a discontinuance by the manufacturer of the specified engine. As the bid was submitted and accepted in good faith in accordance with the general terms and conditions of the tender and was not subject to the availability of the vehicle, legal action against Marigold Lincoln Mercury Sales is a possibility. However, the costs involved in taking such action would likely exceed the additional costs that would be incurred by accepting the second low bidder. It is therefore recommended that the original contract award to Marigold Lincoln Mercury be cancelled and that the 2nd low bid from Nurse Chevrolet Oldsmobile be accepted. The total allocated funds included in the 1993 Community Services Capital Budget account #7603-00001-0504 are $20,000.00 as reflected on page 202 of the Capital Budget. The Treasurer has reviewed the funding requirements and concurs with the recommendation. Queries with respect to department needs, i specifications, etc. , should be referred to the Director of Community Services .
