Subject: TENDER CL94-31, FOSTER CREEK TRAIL LANDSCAPING (PHASE II)

Recommendations:
It is respectfully recommended that the General Purpose and
Administration Committee recommend to Council the following:
1 . THAT Report TR-91-94 be received;
2 . THAT J. Kamstra Landscaping Limited, Oshawa, Ontario, with a
total bid in the amount of $22, 763 . 00 (including all taxes) ,
being the lowest responsible bidder meeting all terms,
conditions and specifications of Tender CL94-31, be awarded
the contract for Foster Creek Trail Landscaping, Phase II, as
required by the Department of Community Services;
3 . THAT the attached By-law, marked Schedule "A" , be forwarded to
Council for approval; and
4 . THAT the total required funds in an approximate amount of
$25, 263 . 00 ($22, 763 . 00 contract value + $2, 500 . 00 consulting,
design, contract administration and expenses) , be drawn from
the Community Services Capital Budget Account 7603-00001-0516;

BACKGROUND AND COMMENT:
I
Tender specifications were provided by Daniel J. O'Brien &
Associates Ltd. for the construction of Foster Creek Trail
Landscaping as required by the Department of Community Services .
Subsequently, bids were received and tabulated as follows :

A budget allocation of $57, 100 . 00 was provided for this project
which included in addition to the trail and grading etc . , funds to
extend the trail under Edward Street . C.L.O.C.A. , after initially
having no concerns, requested at the permit stage for a hydrolic
study. This study has been done and the municipality is currently
awaiting approval from C.L.O.C.A. for this portion of the project .
As a result, this section is not included in this contract and will
be addressed at a later time. The budget allocation for this
portion of the project is $30, 000 . 00 .
It is recommended that Item 1 . 5 for four (4) benches be changed to
two (2) benches and that the contract be awarded in the amount of
$22, 763 . 00 . The consulting fees for this portion of the project
are estimated to be $2 , 500 . 00 .
The total required funds in the approximate amount of $25, 263 . 00
($22 , 763 . 00 contract value + $2 , 500 . 00 consulting, design, contract
administration and expenses) , will be drawn from the Community
Services Capital Budget Account 7603-00001-0516 and are within the
$27, 100 . 00 budget value (net of the allocation for the C.L.O.C.A.
portion of the project) , as reflected on Page 197 of the 1994
Capital Budget .
The Treasurer has reviewed the funding requirements and concurs
with the recommendation. Queries with respect to department needs,
specifications, etc . , should be referred to the Director of
Community Services .

After further review of the bids by Community Services, Purchasing
and the Consultant, it was mutually agreed that Kamstra
Landscaping, Oshawa, Ontario, be recommended for the contract
award.
Due to the pending wet weather season, a forthwith approval is
requested.

SCHEDULE "A"
THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON
BY-LAW 94-
Being a By-law to authorize a contract between
the Corporation of the Municipality of
Clarington and Kamstra Landscaping in respect
to the Foster Creek Trail Landscaping, Phase
II .
THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS
FOLLOWS :
1 . THAT the Mayor and Clerk are hereby authorized to execute, on
behalf of the Corporation of the Municipality of Clarington
with the Corporation Seal, a contract between J. Kamstra
Landscaping and said Corporation.
2 . THAT this agreement attached hereto as Schedule "A" form part
of this By-law.
By-law read a first and second time this day of October, 1994 .
By-law read a third time and finally passed this day of
October, 1994 .
