Subject: QUOTATION Q94-6, MECHANICAL EQUIPMENT MAINTENANCE CONTRACT
Recommendations:

It is respectfully recommended to Council the following:
1 . THAT Report TR-96-94 be received;
2 . THAT Robert E. Jackson Heating Electrical & Air Conditioning,
Orono, Ontario, with a total bid of $2, 337 . 00 (plus G.S.T. )
for Part "A" and a Journeyman hourly rate of $28 . 00, be
awarded Part "A" of the Mechanical Equipment Maintenance
Contract, as required by the Municipality of Clarington;
3 . THAT the contract award to Robert E. Jackson Heating
Electrical & Air Conditioning be subject to the successful
completion, no later than November 24, 1994, by his employees
of a certified WHMIS course; .
4 . THAT Jack Burgess Plumbing and Heating, Bowmanville, Ontario,
with a total bid price of $1, 150 . 00 (plus G.S .T. ) for Part "B"
and a Journeyman hourly rate of $30 . 00, be awarded Part "B" of
the Mechanical Equipment Maintenance Contract, as required by
the Municipality of Clarington; and
5 . THAT the funds expended be drawn from the respective
facilities 1994 Mechanical Equipment Maintenance.
BACKGROUND AND COMMENT:
Quotations were advertised and invited with bids being received and
tabulated as per Schedule "A" attached.

The general scope of the work is to provide all necessary labour,
materials and equipment to perform service maintenance,
inspections, repairs, as requested and emergency calls on
mechanical equipment, as required by the Municipality of
Clarington, for the period March 31, 1994 to April 30, 1995 .

Due to the delay in awarding this contract, the respective bidders
have agreed to hold their prices firm until September 30, 1995, at
which time the contracts would expire . Although this quotation
request closed in May, 1994 , staff did not have available the
necessary information to make an appropriate recommendation. A
great deal of time has been spent to ensure that the contractor' s
recommended for these contracts are familiar with the requirements
imposed upon them by the Occupational Health and Safety Act . The
Municipality has a responsibility to ensure "due diligence" with
respect to ensuring that contractors and their employees exercise
proper health and safety procedures while on Municipal property.
Staff have met with the Ministry of Labour to discuss this issue
and are now satisfied that we have met our obligation under the
Health and Safety Legislation. Subsequently, it is also
recommended that the contract award to Robert Jackson Heating
Electrical & Air Conditioning be subject to his employees
successfully completing a certified course in WHMIS. It is also
recommended that the subject contractor be given thirty (30) days
in order to fulfil this requirement . Robert E. Jackson has agreed
to this condition. The contractor recommended for Part "B" of this
contract, Jack Burgess Plumbing and Heating has already provided
this training to his employees .
Due to the variation in the type of equipment located at each
Municipal facility, the contract is divided into Part "A" and Part j
"B" .
Part "A" covers the mechanical equipment location at the following
facilities :

Part "B" covers the mechanical equipment located at the following
facilities :
Bowmanville
Animal Control Shelter
Tourist Information Centre
Enniskillen

Newcastle Village
Newcastle Fire Station
Brownsdale Community Centre
Darlington
Hampton Municipal Building
Courtice Fire Station
Darlington Arena
Under the general terms and conditions of Quotation
Q94-6, the
Municipality may without invalidating the bids, award the contract
in whole, or in part, whichever is the in best interest of the
Municipality of Clarington.

With respect to the bid submitted by Robert E. Jackson Heating
Electrical & Air Conditioning, although the total amount bid for
Part "B" is lower than that submitted by Jack Burgess Plumbing &
Heating, the combined hourly rate for emergency repairs for Regular
and Overtime Rates for Journeyman and Journeyman Helper is higher.

In view of the fact that the bulk of this contract is for emergency
repairs, an award to Robert E.Jackson Heating Electrical & Air
Conditioning for Part "B" would not be in the best interest of the
Municipality of Clarington. In addition, the cost plus for parts
and materials is less from Jack Burgess than Robert E. Jackson
Heating Electrical & Air Conditioning.
The total expenditure for this contract for 1993 was approximately
$41, 000 . 00 . Of this total only $5, 486 . 00 was for preventative
maintenance, the combined total bid price for Part "A" and "B" .
Any emergency repairs that may be requested are over and above the
total bid amounts for Part "A" and Part "B" are charged at the
hourly rate . Of the $35, 514 . 00 total for emergency repairs,
approximately $22 , 514 . 00 ' is for labour and the balance of
$13 , 000 . 00 is for parts.
The price bid for Part "A" and "B" represent an approximate 280
decrease and 0 increase/decrease respectively over the price bid
for the 1993 contract .
The Treasurer has reviewed the funding requirements and concurs
with the recommendation. Queries with respect to department needs,
specifications, etc . , should be referred to the Director of
Community Services .
After further review and analysis of the quotations, it was
mutually agreed by Purchasing and Community Services that Robert E.
Jackson Heating Electrical & Air Conditioning, Orono, Ontario, be
awarded Part "A" and that Jack Burgess Plumbing and Heating,
Bowmanville, Ontario, be awarded Part "B" of the Mechanical
Equipment Contract .

Jack Burgess Plumbing and Heating have previously performed
satisfactorily for the Municipality of Clarington. Although Robert
E. Jackson Heating Electrical & Air Conditioning have not
previously provided service for the Municipality of Clarington,
they have provided satisfactory service. at numerous locations for
Syvan Developments Ltd. in Newcastle.
