BACKGROUND AND COMMENT: In accordance with Resolution #C-688-94, the Administrator and the Treasurer awarded Tender CL94-40 Wilmot Creek Pedestrian Bridge, Clarington Waterfront Trail. Tender specifications were provided by Totten Sims Hubicki Associates for the Wilmot Creek Pedestrian Bridge, Clarington Waterfront Trail, as required by the Department of Public Works. Tenders were advertised in local papers, as well as the Daily Commercial News. Subsequently, tenders were received and tabulated as per Schedule "A" attached. The total project cost as detailed in the letter from Totten Sims Hubicki Associates, marked Schedule "B", is estimated at $95,000.00. The funding for this project is as identified in Report TR-97-94, a copy of which is attached marked Schedule "C". The low bidder has previously performed satisfactorily for the Municipality of Clarington. They have also provided excellent service for the City of Oshawa. The Treasurer has reviewed the funding requirements and concur with the recommendation. THAT Report TR-97-94 be received; 2 . THAT the Chief Administrative Officer and Treasurer or their delegates be authorized to accept the lowest qualified tender meeting all terms, conditions and specifications of Tender CL94-40, Wilmot Creek Pedestrian Bridge, Clarington Waterfront Trail, as required by the Municipality; 3 . THAT the Mayor and Clerk, subject to recommendation #2 above, be authorized to execute the necessary contracts or agreements; 4 . THAT an information report and the applicable By-law be presented at the General Purpose and Administration Committee Meeting, scheduled for November 21, 1994 , summarizing the tender that has been awarded; S . THAT $60, 000 . 00 of the Municipality' s contribution be drawn from the 1994 approved Public Works Capital Waterfront Trail Budget Account #7205-94003-0261; and 6 . THAT $4, 790 . 00 be drawn from the Planning Department' s 1994 Legal Account #7702-00000-0242 . BACKGROUND AND COMMENT: For the past several weeks, staff have been negotiating the details of the Wilmot Creek Pedestrian Bridge, Claringto-r Waterfront Trail, with representatives from the Province of Ontario. One of the conditions for funding imposed by the Province is -hat the work be substantially completed by the Sp-ring of 1995 . In order to meet this deadline, it is necessary to award this contract so that work can commence before there is frost in the ground. ® 13 9, REPORT NO. : TR-97-94 PAGE 2 ACCEPTANCE OF TENDER CL94-40 Consequently, the tender has been issued, with bids closing Friday, October 28, 1994 . As this tender closing is after the last formal meeting of the current Council, it is recommended that the Chief Administrative Officer and the Treasurer, or their delegates, be authorized to accept the lowest qualified tender meeting all terms, conditions and specifications of Tender CL94-40 , the Wilmot Creek Pedestrian Bridge, Clarington Waterfront Trail, and that the Mayor and Clerk be authorized to execute the necessary contract. In some cases, the low bidder may not be the most qualified with respect to reference or quality of product offered and in this case, the most appropriate low bid would be selected. This procedure is consistent with that adopted during the Council August break. For the information of Council, staff have confirmed with the Ministry of Municipal Affairs that establishing this procedure is within Council' s authority. The total estimated cost for Phase I is $2.59, 162 . 00 and for Phase II is $65, 566 . 00 . Phase I will receive 75% subsidy and Phase II will receive 100% from the Waterfront Regeneration Trust for a total of $259, 938 . 00 . To date, the Municipality has received 50% of the total subsidy available fo-- this project in the amount of $129, 969 . 00 . The Municipality' s total contribution of up to $60 , 000 . 00 will be drawn from the -994 Public Works Capital Budget Account Waterfront Trail #7205-94003-0261 as identified on Page 40 of the Capital Budget . An additional $5 , 790 . 00 related to legal costs associated with easement agreements has been provided for in the Planning Department 1994 Legal Account #7702-00000-0242 . Phase I includes the Waterfront Trail from Bowmanville to Bond Head and Phase II from Darlington Provincial Park to Boamanville . The estimated cost of this portion of Phase I, which includes the Wilmot Creek Pedestrian Bridge is 580 , 000 . 00 .
