THAT Report TR-7-94 be received, and;' 2 . THAT rental of the Probation Offices in the amount of $9,852 . 00 annually from September 1, 1993 be approved; and 3 . THAT the attached By-law, marked Schedule "A" , authorizing the Mayor and Clerk to execute a Lease Agreement with Her Majesty the Queen, as represented by the Ministry of Government Services for the Province of Ontario, for the rental of the Probation Offices in the premises located at 132 Church Street, Bowmanville, be executed. BACKGROUND AND COMMENT The Ministry of Government Services currently leases 821 square feet of space from the Municipality of Clarington at 132 Church Street, Bowmanville for the probation offices. The existing lease expired June 30, 1993 . The proposed lease is for a 5 year term, effective on September 1, 1993 and expiring August 31, 1998, at an annual amount of $9,852 .00. The proposed rate reflects an approximate 20% increase over the current rate of $8,210.04 . With respect to the operating costs of the building, the lease includes both escalation and deescalations clauses . The base costs per square foot, per annum will be adjusted to the most current year's operating costs . 4- cl- 11i,S IS MMW BEGY-D PAIIER REPORT NO. : TR-7-94 PAGE 2 LEASE AGREEMENT - PROBATION OFFICES For the information of Council, both the Municipality and the tenant have the right to cancel the agreement upon three (3) months written notice. As part of the terms and conditions of the lease agreement, the tenant has stipulated certain minor repairs that must be completed by the Municipality. These repairs will amount to approximately $2,000. 00 and have been identified in the 1994 Community Services Capital Budget. THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk are hereby authorized to execute, on behalf of the Corporation of the Municipality of Clarington with the Corporation Seal, a Leasing Agreement with her Majesty the Queen and said Corporation. 2. THAT this agreement attached hereto as Schedule "A" form•part - -. . - of this By-law By-law read a first and second time this day of April, 1994.
