THAT Report TR-22-94 be received; 2 . THAT George H. Harding Construction Co. Ltd. , Whitby, Ontario, with a total bid in the amount of $494,781. 12 being the lowest responsible bidder meeting all terms, conditions, and specifications of Tender CL94-3, be awarded the contract for the Reconstruction of Mearns Avenue, as required by the Department of Public Works; and 3 . THAT the funds in the amount of $520,000. 00 be drawn from the approved 1994 Public Works Capital budget, account #7205-94001-0261 . BACKGROUND AND COMMENT: Tender specifications were provided by Totten Sims Hubicki Associates for the Reconstruction of Mearns Avenue as required by the Department of Public Works. Tenders were advertised in the local papers, as well as the Daily Commercial News. Subsequently, tenders were received and tabulated as per Schedule "All attached. The Municipality of Clarington's portion of the total project cost as detailed in the letter from Totten Sims Hubicki Associates, marked Schedule "B" is estimated. at $520,000. 00, which is within the budget allocation of $708,000. 00, as reflected in the 1994 Draft Capital Budget, Page 30. Included in the total tendered price of $494,781. 12 is work to be performed on behalf of the Region in an approximate amount of $85,806 - 00 and they will be invoiced as appropriate. 1 4- _T REPORT NO. : TR-22-94 PAGE 2 TENDER CL94-3 It is proposed that the required funds be drawn from the Public Works Capital budget, account #7205-94001-0261. The low bidder has previously performed for the Municipality of Clarington in the Reconstruction of Holt Road in 1991-1992 . As indicated in the attached letter from Totten Sims Hubicki Associates, marked Schedule "B" , our experience with this firm was not entirely favourable. However, as indicated, they have since j performed satisfactorily for the Town of Whitby, the Regional Municipality of Durham, and Harnden and King Construction. Staff and Totten Sims Hubicki Associates have met with the subject firm and are confident the work can be completed satisfactorily. The Treasurer has reviewed the funding requirements and concurs with the recommendation. Queries with respect to department needs, specifications, etc . , should be referred to the Director of Public Works . After further review and analysis of the bids by Public Works, Totten Sims Hubicki Associates and Purchasing, it was mutually agreed that the low bidder, George H. An Agreement to Bond was supplied and a deposit cheque of$19,000 accompanied the bid. George Harding Construction Company Limited has previously undertaken work for the Municipality of Clarington(then known as Town of Newcastle) in 1991-1992. The project was Holt Road reconstruction and our experience with this firm in that contract was not entirely favourable. However, since the completion of the Holt Road contract, George Harding Construction has completed projects for the Town of Whitby and subcontract work under Hamden and King on other projects and has been awarded several contracts by Oshawa and Whitby for 1994. References that we have checked with the Town of Whitby, Hamden and King Construction, Consultants G.M. Sernas and Region of Durham for more recent works indicate satisfaction with the work undertaken. Your Mr. Don Patterson and D.R. Bourne of Totten Sims Hubicki Associates met with the contractor principle Mr. Robert Harding on April 20, 1994 and discussed the complexities of the current tender and of his past performance. We are confident the work can be completed to the satisfaction of your consultants and the Municipality of Clarington. The Mearns Avenue Contract No. CL94-3 is the largest single contract successfully bid by George Harding Construction and the company has expressed confidence in their ability to complete the work on time. On the evidence of work completed in recent years we recommend acceptance of the low bid of George Harding Construction. The total value of the work chargeable to the Municipality of Clarington is estimated as follows: Road Works - Section 1 and General Items - Section 4 1. By Contract (Section 1) $401,544.26 2. By Contract (Section 4, Prorated) 7,430.00 3. Contingency Allowance 15,000.00 4. Final Design and Tendering (Jan. - April 1994) 5,000.00 5. Construction Administration 45,000.00 6. Tree Planting 8,000.00 GST (Items 1, 2, 4, 5, 6 and 7) 33,035.74 Total Cost $520,000.00 Of the total cost sidewalk construction and tree planting are works which are not eligible for subsidy by the Ministry of Transportation. These costs amount to approximately $74,500 including GST.
