THAT Report TR-39-94 be received; 2 . THAT Rutherford Contracting Ltd. , Gormley, Ontario, with a total bid in the amount of $141,849 .44, being the lowest responsible bidder meeting all terms, conditions and specifications of Tender CL94-27, be awarded the contract for Rotary Park - Phase III as required by the Department of Community Services; 3 . THAT the attached By-law, marked Schedule "All be forwarded to Council for approval; and 4 . THAT the total required funds of $161,849 .44 ($141,849 .44 contract + $20,000. 00 consulting, design and contract administration) be drawn from the approved 1994 Community Services Capital Budget Account #7603-00001-0516 . BACKGROUND AND COMMENT: Subsequently, tender specifications were provided by Cosburn Giberson Landscape Architects for Phase III of the project. Wallans $193,297 . 18 Construction Brighton, Ontario 825999 Ontario Limited $197,005. 35 Queensville, Ontario Dave Boyle Excavating Ltd. $206,835 . 89 Ajax, Ontario Bry Ron Contracting Limited $230,823 . 69 Ajax, Ontario 961488 Ontario Ltd. $250,000.00 o/a Sanan Construction Maple, Ontario For the information of Council, resolution #GPA-103-94, identified "that the Rotary Park Project be deleted from the Community Services 1994 Capital Budget and four year forecast" . Omitted from this resolution was "that it be subject to funds being available through the infrastructure program. " Subsequent to this resolution this project was deleted from the infrastructure program as it did not meet the program requirements. Therefore the funds were left in the 1994 Community Services Capital Budget. I i REPORT NO. : TR-39-94 PAGE 3 TENDER CL94-27 The total required funds in the amount of $161,849 .44 ( 141,849 .44 Contract . + $20, 000 . 00 consulting, design and contract administration) will be drawn from the approved Community Services Capital Budget Account #7603-00001-0516 and are within the $272,500. 00 allocation as identified on Page 206 of the draft Capital Budget. The Treasurer has reviewed the funding requirements and concurs with the recommendation. Queries with respect to department needs, specifications, etc. , should be referred to the Director of Community Services . After further review and analysis of the bids by Purchasing, Cosburn Giberson Landscape Architects and Community Services, it was mutually agreed that the low bidder, Rutherford Contracting Ltd. , Gormley, Ontario, be recommended for the contract for Rotary Park - Phase III . The subject firm previously performed satisfactorily for the Municipality of Clarington. See attached letter from Cosburn Giberson Landscape Architects, marked Schedule "B" . THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON HEREBY ENACTS AS FOLLOWS: 1. THAT the Mayor and Clerk are hereby authorized to execute on behalf of the Corporation of the Municipality of Clarington with the Corporation Seal, a contract between Rutherford Contracting Ltd. and said Corporation. 2 . THAT this agreement attached hereto as Schedule "A" form part of this By-law. By-law read a first and second time this day of June, 1994. By-law read a third and finally passed this day of June, 1994.
