THAT Report EGD-11-02 be received; 2. THAT the Director of Engineering Services be authorized to issue a 'Certificate of Acceptance' for the Roads and Above Ground Services, which include final stage roads and other related Works, constructed within Plan 10M-832; and 3. O(;~_~~ eVlewed by: Franklin Wu Chief Administrative Officer NAC*ASC*ce 09/18/2001 705 REPORT NO.: EGD-11.02 PAGE 2 1.0 BACKGROUND 1.1 The former Corporation of the Town of Newcastle entered into a subdivision agreement registered on October 4, 1989 with Kiddicorp Investments Limited to develop lands by plan of subdivision, located in Courtice and described as Plan 10M-832 (Attachment 1). The agreement required the developer to construct all roadworks, including hot-mix paving, curb and gutter, sidewalks, boulevard sodding and street trees, a storm drainage system and street lights. hereinafter referred to as the 'Works'. 1.2 The Subdivision Agreement provides for the separation of the Works into two (2) stages: a) Storm Sewer System; and b) Roads and Above Ground Services 1.3 The Storm Sewer System was previously assumed by the Municipality, in accordance with the requirements set out in the Subdivision Agreement. 1.4 The Roads and Above Ground Services were issued a 'Certificate of Completion' dated December 1, 1999 (Delays were encountered due to slower sales of larger executive homes in the subdivision). This initiated a two (2) year maintenance period which expired on December 1, 2001. The Works have been reinspected and all deficiencies have now been rectified to the satisfaction of the Director of Engineering Services. 1.5 It is now appropriate to issue a 'Certificate of Acceptance' for the Roads and Above Ground Services. The Subdivision Agreement requires Council approval prior to the issuance of any 'Acceptance Certificate' for Roads and Above Ground Services. 706 REPORT NO.: EGD-11-02 PAGE 3 1.6 Further to the issuance of a 'Certificate of Acceptance'. a by-law is required to permit the Municipality to assume the streets within Plan 10M-832 as public highway (Attachment 2). ( ( 'I I I[ I ) -~ / REPORT EGD-II-02 ATTACHMENT NO. 1 FEB. 2002 70 , THE CORPORATION OF THE MUNICIPALITY OF CLARINGTON BY-LAW 2002- Being a By-law to assume certain streets within the Municipality of Clarington as pubic highways in the Municipality of Clarington. NOW THEREFORE the Council of the Corporation of the Municipality of Clarington hereby enacts as follows: 1. THAT the street and blocks shown on Plan 10M-832 and listed below and listed in this section, all being in the Municipality of Clalington, in the Regional Municipality of Durham, are hereby accepted by the Corporation of the Municipality of Clarington as public highways, and assumed by the said Corporation for public use: Robert Adams Olive Sagewood Avenue Auburn Lane Auburn Couli Worthington Olive Thombury Street Blocks 87 to 92 inclusive BY-LAW read a first and second time this 25" day of February 2002.
