LONGER NEEDED FOR A TEMPORARY TURNING CIRCLE ON
MALLORY STREET
Recommendations:
It is respectfully recommended that the General Purpose and Administration Committee
recommend to Council the following:
1. THAT Report EGD-10-02 be received;
2. THAT a by-law be passed to authorize the Mayor and Clerk on behalf of the
Municipality of Clarington to transfer Part 1 on Plan 40R-17268 for a nominal
consideration either to the Trulls Land Corporation or to its direction; and
3. THAT a copy of this report be provided to the Trulls Land Corporation.

1.0 BACKGROUND
1.1 A Subdivision Agreement dated November 15, 1996 respecting the lands now in
Plan of Subdivision 40M-1860 was made between the Municipality of Clarington
and Trulls Land Corporation. The Agreement was registered on title as
Instrument No. L T779706. A copy of Plan of Subdivision 40M-1860 is contained
in Attachment No.1.
1.2 Plan of Subdivision 40M-1860 shows the alignment of part of Mallory Street.
Mallory Street was planned to be extended to the northwest of its alignment on
Plan 40M-1860. In order to provide for a temporary turning circle at the
northwest end of Plan 40M-1860 until the extension of Mallory Street was
completed, the Municipality took a transfer of the necessary lands shown as Part
1 on Plan 40R-17268 from the owner. The intention was that Part 1 on Plan
40R-17268 would be transferred back to the owner when Mallory Street was
extended for a nominal consideration. Unfortunately, the Subdivision Agreement
does not express this intent clearly.
1.3 Mallory Street has now been extended to the northwest of Plan of Subdivision
40M-1860 and the temporary turning circle is no longer required.

2.0 CONCLUSION
2.1 It is recommended that Council pass a by-law to authorize the transfer of Part 1
of Plan 40R-17268 either to the transferor of it to the Municipality or to the
transferor's direction for a nominal consideration.
